RESOLUTION NO. 718 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH REPORTING FINDINGS AND MAKING RECOMMENDATIONS ON A PROPOSED AMENDMENT TO THE ZONING ORDINANCE PERTAINING TO LOT COVERAGE. WHEREAS, in the matter of the proposed amendment to the zoning ordinance pertaining to lot coverage, the Planning Commission of the City of Seal Beach does report as follows: 1. The Planning Comm1ssion recently completed a study regarding overbuilding and possible increase of lot coverage in District II. 2. Recommendations were sent to the City Council on a possible action regarding overbuilt homes. 3. The City Council considered the Planning Commission recommendations and, after discussion, directed the Planning Commission to hold a public hearing on the following proposed amendment: "Article 18: General Provisions, Conditions and Exceptions, Yards, Height, Open Space and Bulk. 1>) Sec. 1805.1, Exceptions Notwithstanding any other lot coverage requirements of this Code, each res1dente in the R-l Zone of District II shall also be permitted one covered patio having an area of not more than 5% of the area of the lot." 4. In the interest of clarification of the legislative intent of the proposed amendment, the following addit10nal proposed amendment was considered: "Article 2: Definitions a) Sec. 224.1, Covered Patio "Covered patio" means a roofed space supported by posts or columns which is unscreened and unenclosed." WHEREAS, the Planning Commission findings are as follows: 1. A public hearing was advertised as required by law and ordinance. 2. A public hearing was held. 3. No written communications were received and no members of the audience spoke on the measure. 4. The Planning Commission considered the merits of the two proposed amendments and discussed the questions at length. . . . . \. . . Resolution No. 718 - 2 5. The proposed amendment would, in the opinion of the Planning Commission, effectively raise the R-l, District II, lot coverage to 45% and in some cases to above 45%. 6. The Planning Commission wis of the opinion that no matter what maximum lot coverage provis1ons are 1n force, some developers will build to maximum coverage and request additional coverage. 7. The Planning Commission restated their consensus that 40% coverage was a desirable standard which has been satisfactory in Seal Beach and is a standard in many other communities in the R-l zone. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby report back to the City Council that the Planning Commission does not favor the proposed amendment and would reaffirm their previous findings and recommendations contained in Resolution No. 703 dated November 15, 1972. ADOPTED AND APPROVED this 3rd day of January, 1973.
