A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING USE VARIANCE UV-5-74
(WARNO-CHESHIREl
An appl1catlon was duly flled by Ilenryk Warno (Mlchael Cheshlre). 302 ~laln St.,
Seal Beach. CA, for a Use Varlance to permit on-sale beer and Wlne In the C-l
zone ln conJunct1on w1th a restaurant.
The appllcant's property 15 descrlbed as portlons of Lots 1, 2 and 3, Blo~k 209,
Bay Vlew Tract, and lS more commonly known as 306 Maln St.
A publlC hearlng was set and held before sa1d Comm1ss10n on October 16, 1974,
and notlce of sald hearlng was duly glVen.
Wrltten lnformatlon was revlewed and oral cOIIGents were recelved by the Plannlng
Comm1ss1on.
The Plannlng Commlsslon now makes the followlng flndlngs:
1. The subJect property has recently been rezoned from C-2 to C-l.
2. Under the preVlOUS C-2 zone on-sale beer and wine was perm1tted on the
subJect property w1th no adverse effects.
3. The proposed zonln9 ordlnance Wlll permlt on-sale alcoholic beverages ln
the C-l zone subJect to a Condltlonal Use Permlt.
4. A Pollce Department report flled Wlth the Plannlng Comm1SS10n on the
appl1catlon shows no reason why the llcense should not be lssued.
5. No structural alterations or addltlons are proposed for the bUlldlng.
6. The proposed use 15 compatlble wlth other uses ln the area.
NOW, THEREFORE, BE IT RESOLVED that the Plannlng Commlsslon of the Cltf of Seal
Beach does hereby approve Use Varlance UV-5-74 subJect to the follow1ng condltlons:
1. Use Varlance to be lssued for a perlod of one year wlth renewal prOVlSlons.
2. Use Varlance for on-sale beer and Wlne only.
3. Use Varlance to be lssued to Mlchael Chesh1er only.
4. Appllcant" to SUbm1t a letter to the Clty WhlCh provldes for addltlonal
park1ng for the restaurant use.
ADOPTED AND APPROVED thlS 16th day of October, 1974.
