RESOLUTION NO. 866
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH RECO~l~IENDING THAT THE
CITY COUNCIL CONDITIONALLY APPROVE APPEAL
NO. A-3-74 (STUKALOFF)
An application was duly filed by Les Stukaloff, 2061 Rancho La Merced, Covina,
California, appealing Planning Commission denial of Variance V-aG-74 to permit
less than the required rear yard setback or with modifications to the building
permitting three parking stalls of less than the required length for a four
unit building located in the Multiple Residential Zone.
The applicant's property is described as Lot 12 and 1/2 of Lot 14, Block 2,
Bay City Tract and is mOTe commonly known as 112 2nd St.
The appeal application was referred to the Planning Commission by the City
Council, and was considered by the Commission at their meeting of September 4,
1974.
Written information was reviewed and oral co~ents were recelved by the
Planning Conlffilssion.
THE PLANNING Cm1MISSION NOW ~'AI<ES TIlE FOLLOWING FINDINGS:
.
a. The granting of the appeal will not adversely affect the general plan.
b. Requiring major modifications of the existing building to obtain compliance
with all code provisions would result in extreme and unnecesssary hardship
to the appl icant.
c. The circumstances that pertain to this application are unique in that the
building has already been constructed.
d. With a 9-foot rear yard setback, access to the three parking stllll s at the
rear of the property would be greatly improved.
e. This property is situated in an unusual location with alleys at both the
side and rear of the property providing vehicular access to the site.
NOW, THEREFORE, BE IT RESOLVED that the Seal Beach Planning Commis5ion dues
recommend that the City Council conditionally approve Appeal Application 110.
A-3-74 subject to the following conditions:
I. That the rear of the building be modified to hold a 9-foot setback from
the rear property line.
2. That'all steel posts be removed from the rear yard setback.

AND, BE IT FURTHER RESOLVED that the Planning Commission does recommend that
if the appeal is granted that two of the four units of the building be permitted
to be occupied immediately.
ADOPTED AND APPROVED this 4th day of September, 1974.
