Mr. Hanz11k expla1ned that no 1andscap1ng would be changed and property would
be upgraded. Hear1ng closed. Mr. Cook moved to deny the var1ance. Motlon falled
for lack of a'second. Mr. R1pperdan moved to approve the var1ance subJect to
executlon of a land use agreement 11mltlng number of un1ts. reserv1ng park1ng
and prov1dlng for annual 1nspectlon, and the cond1t10n that the doorway In the
entry area rema1n open. Seconded by Mr. Schmltt.

Proposed varlance to perm1t three parklng spaces of less than requlred length
and less than requlred rear yard setback at 112 2nd St. Hear1ng open. Mr.
Goldman. representlng the app11cant. exp1a1ned the bu11dlng was complete except
for certlflcate of occupancy. Plans had been approved by the BU11d1ng Dept.
He further explalned that there was no lntent to v101ate tile ordlnance and there
was no beneflt to the app11cant. Flfteen letters were presented by the app11cant
1n favor of the proposal. Mr. Stukaloff exp1alned the error occurred dur1ng
draftlng of flna1 plans. Mr. Goldman exh1b1ted that sufflC1ent turnlng rad1US
was avallable. A petlt10n was recelved ln Oppos1t10n to the varlance from
ne1ghbors ln the area. Ken Coombs. 201 Dcean, spoke 1n Opposltlon. Mr. Peters,
211 Ocean, spoke 1n Oppos1t10n and p01nted out that Mr. Stukaloff had acted as
hlS own general contractor. He also adv1sed that steel posts 1nsta11ed on the
proper~ further reduced the turn1ng rad1us. He suggested there was a lack of
coordlnat10n and 1nspectlon to dlscover errors llke these. Ruth F1em1ng, 2D9
Ocean. spoke In protest and also obJected to the 10cat10n of the steel posts.
Mr. Goldman re1terated that Mr. Stuka10ff d1d not lntend to v101ate any ord1nance.
Hear1ng closed. Mr. SChm1tt felt that the app11cant as owner bUl1der was
personally responslb1e for any errors. D1Scuss10n of methods of rect1fY1ng the
