804
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH CONDITIONALLY APPROVING AND
RECOMMENDING CITY COUNCIL APPROVAL OF THE
TENTATIVE MAP FOR TRACT NO. 8534 FOR A 60 UNIT
CONDOMINIUM ON 7.85 ACRES OF LAND IN THE COLLEGE
PARK EAST/OLD RANCH COUNTRY CLU8 AREA. (BIXBY)
WHEREAS. in the matter of tentative map~for Tract No. 8534. the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject case initiated by Bixby Ranch Co.. 523 W. 6th St.. Suite 728.
Los Angeles. CA.
2. Subject property described as Tract No. 8534. bounded by Lampson Avenue.
Cand1eberry Avenue. Aster Street and Basswood Street.
3. Subject proposal is to divide the property into two parcels. one parcel of
.6 acre for a public park. the other parcel of 7.25+ acres for development
of 60 condominium units and a private clubhouse. --
WHEREAS. the Planning Commission findings are as follows:
1. Subject proposal meets spirit and intent of Subdivision Hap Act and
the Subdivision Ordinance.
2. Variance was requested from three provisions of the Subdivision Ordinance.
(a) perimeter wall, (b) dedicated streets. and (c) bicycle trail system.
3. Planning Commission was of the opinion that perimeter wall requirement
shou1~ be waived except along Lampson Avenue where a combination wall and
earth berm was proposed.
4. Due to the scope of the project and street pattern, the Planning Commission
was of the opinion that streets should not be dedicated.
5. The size of subject property does not lend itself to the incorporation of
a bicycle trail system.
6. Planning Commission recommends that City Council require park land dedication
rather than fees.
7. A member of the audience raised the question of the City's legal position
regarding approval of a project in an area which might fall with the 65
CNEL Zone and therefore might be subject to State of California, Department
of Aeronautics. rulings regarding construction of low rise residential
buildings. Planning Commission recommends that the City Council request
an opinion from the City Attorney on this matter.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve and recommend to the City Council the approval of the
tentative map for Tract No. 8534 and that dedication of land for a parksite be
required in lieu of fees. The following additional recommendations are made
to the City Council:

1. If it is determined that the parksite will be used as a tennis court, it
is recommended that the park be located at Basswood and Aster as proposed
on the tentative map. If it is determined that the parksite will be used
for other recreational purposes, it is recommended that it be located at
the corner of Candleberry and Aster.
2. It is recommended that the City Council request that the City Attorney
render an opinion regarding the City's legal position pertaining to approval
of said project as it may relate to the State's Department of Aeronautics
regulations affecting construction of low rise residential buildings within
the 65 CNEL Zone limits (Community Noise Equivalent Levels).
3. It is additionally recommended that the requirements under the Subdivision
Ordinance be waived pertaining to the perimeter wall, dedication of streets,
and bicycle trail system.
ADOPTED AND APPROVED this 16th day of January, 1974.

meeting of the Planning Commission of the City of Seal Beach which was held on
Wednesday, January 16. 1974. and carried by the following vote:
