RESOLUTION NO. 943 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING V-19-75 FOR RELIEF FROM A CONDITION IMPOSED BY THE PLANNING COMMISSION AND CITY COUNCIL REQUIRING A REPLACEMENT USE IN A PORTION OF A COMMERCIAL BUILDING TO REQUIRE TWO PARKING SPACES AT 91~ ELECTRIC. WHEREAS, an application was duly filed by JacQueline Miller (Dr. Kimmel) 413 Marble Cove Way; and WHEREAS, the property is legally described as portions of Lot 8, Block 209, Bay View Tract and more commonly known as 915~ Electric Ave.; and WHEREAS, the request is for relief from a condition imposed by the Planning Commission and City Council in 1971 reQuiring a replacement use in a commercial building to require no more than 2 parking spaces; and WHEREAS, the proposed use, optom4try, technically would require 3 spaces for the subject floor area; and WHEREAS, the applicant is proposing a use which is less intensive than the previous use; and WHEREAS, circumstances relating to the property are that the applicant is starting out in business with no established clientele and the use should not generate a large parking demand. NOW~ THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance V-19-75 subject to the obtaining of a letter from the property owner assigning two parking spaces for this use and the affirmation by City Council of relief from the condition previously imposed requiring a use re~uiring no more than 2 parking spaces.
