RESOLUTION NO. 889
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH RECOMMENDING THAT THE CITY
COUNCIL DENY APPEAL A-5-74 FILED BY BRUCE
TASCHNER
An application was duly filed by Bruce Taschner, 601 Beachcomber Drive, Seal
Beach, appealing the Planning Commission denial of Variance V-35-74 to permit
a fence which exceeds maximum permitted height in the front yard setback in
the R-l zone to remain.
The applicant's property is described as Lot 140, Tract 2590 and is more commonly
known as 601 Beachcomber Drive.
A Public Hearing was set and held before the City Council on January 13, 1975,
and notice of said hearing was duly given.
The City Council voted to refer the matter back to the Planning Commission
with recommendations that the Commission consider the unu9ual location of the
property as it relates to noise levels as grounds for approval of the request.
On February 5, 1975, the Planning Commission considered the City Council 's
referral of Appeal A-5-74 and voted to report back to the City Council the
Planning Commission's affirmation of its finding in Planning Commission
Resolution 878 and to recommend that the City Council deny Appeal A-5-74 for the
following reasons:
1. The wall as built could not effectively reduce noise.
2. The subject property is not directly across the street from the school and
noise from the school would effect other properties to a greater degree
than the subject property.
3. Traffic speed should be reduced on Bolsa due to a newly installed stop
sign at Bolsa and Balboa.
4. The garage at 601 Beachcomber has been illegally converted by the addition
of an office in the garage which does not permit the parking of two
automobiles in the garage as required by the zoning ordinance.
5. No hardship exists due to size, shape, topography or location of the
subject property.
6. Fences in front yard setbacks over 42 inches in height should not be
permitted because of needed sight clearance for motorists backing out of
driveways onto the street.
7. There is no justification for a 7 foot high fence in the front yard setback.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does reaffirm its findings in Resolution 878 and recommend that the City
County deny Appeal A-5-74.
I hereby certify that the foregoing resolution was duly adopted at a regular
meeting of the Planning Commission held on Wednesday, February 5, 1975, and
carried by the following vote:
