RESOLUTION NO. 969 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING AND RECOMMENDING THAT THE CITY COU~CIL ADnPT AMENDMENTS TO CHAPTER 28 (ZONING) OF THE CITY CODE, ARTICLE 5, SECTION 28-506 (5)(a) AND (d) TO PERMIT WINDSCREENS TO BE CONSTRUCTED ON 10 FOOT WIDE DECKS LOCATED ON LAND LEASED FROM SURFS IDE COLONY ADJACENT TO RESIDENCES ON "A" ROW. WHEREAS, Surfside Colony, Ltd. owns a strlp of land adJacent to prlvate property situated on "A" I?ow; and WHEREAS, Surfslde Colony, Ltd. wlll lease a 10 foot wlde strip of land to adJacent property owners; and WHEREAS, stalrways, balconles, patlo decklng and roof projectlons may encroach lnto thlS leased land, and WHEREAS, the Plannlng Commisslon received a request from Surfside Colony Board of Dlrectors to amend the zonlng ordlnance to allow glass enclosures (wlndscreens) on the 10 foot wide balconies or patlo decks on "A" Row; and WHEREAS, the Planning Commlsslon held a publlC hearing on Wednesday, February 4, lQ76, to conslder the prooosed amendments concernlng the glass enclosures, and WHEREAS, a number of Surfslde Colony residents spoke ln favor of the proposed amendments. NOW, THEREFORE, BE IT RESOLVED that the Plannlng Commlssion of the Clty of Seal Beach does hereby approve and recommend that the City Councll amend Section 28-506 (5)(a) and (d), Artlcle 5, Chapter 28 of the Clty Code to read as follows: (a) (d) First floor - - ten feet with glass deck enclosure, The decking may have a forty-two inch high guard railing lnstalled thereon as requlred by the building code. On the flrst floor deck, in addltlon to the fortv-two lnch hlgh guard raillng. a glass deck enclosure may be added. The glass enclosure shall not exceed 8 feet measured from the flnished floor of the deck. ~o glass panel shall be less than 3 feet by 3 feet. All glass above the forty-two lnch high guard ralllng shall be clear, untlnted glass. No portlon of the glass enclosure shall be covered or roofed in any manner. ... . . . . .
