RESOLUTION NO. 1094

A RESOLUTION OF THE SEAL BEACH PLANNING
COl1M1SSION APPROVING AND RECOMMENDING TO
CITY COUNCIL APPROVAL OF TENT~TIVE TRACT
MAP. NO. 10079.
WHEREAS, an appl Icatlon was duly f1led by Monteclto Elght, a llm1ted
partnershl p, 9461 Gralldl ay Strcet, Cypress for Tentatl ve
Tract Map NO.10079; and
WHEREAS, the property lS descrlbed as Lot 3 , Tract No. 9458 and lS
morp commonly ~nown as 12530 Montec1to Road, Seal Bcach,
and
WHEREAS, the proposal is to convert a nlne unlt apartment bU1ldlng
lnto a nlne unlt condom1nlum ln the R-3 zone; and
WHEREAS, the Plannlng Comm1ssion makes the followlng find1ngs re-
gardlng the Tract Map.

1. The slte lS physlcally suitable for development, the land
1S flat and lt 1S located ln a developed area Wltn eYlst-
ing streets, utllltles, res1dences, and commerc1al actlvlt1es
located adJacent to the proJect slte.
2. The site is sUltable for the proposed density of development;
other projects of slmllar dens1ty have been constructed and
are compatlble with the area.
3. The deslgn of the subdlvislon wlll not cause substan.lal
envlronmental damage.
4 The deslgn of the subdivlslon is not llkely to cause serious
publlC health problems because all the necessary utl~~t1es
and serV1ces are avallable for the proJect.

5. The deslgn of the subdivls10n wlll not confl1ct wlth ease-
ments, acquired by the publlC at large for access t~rough,
or use of, property w1thin the proposed subd1vlslon ~ecause
no easements acqu1red by the publlC at large are located on
the proJect slte.
6. The d1scharge of waste from the proposed subd1v1s10n lnto the
existlng communlty seller system will not vlolate eXlstlng
requlrements prescr1bed by the local reglonal water ~uallty
control board pursuant to Dlvislon 7 of the Water Code
7. No resldents w1ll be d1splaced by the proJect because no
units are occupled
8. The proJect lS exempt from the provlslons of C.E Q A.
NOW, THEREFORE BE IT RESOLVED that the Plann1ng Commlsslon does hereby
approve Tentat1 ve Tract t.lap No 10079 and recommends to Cl ty Councll approval
of the fract Map subJect to the followlng condltlons
1. C C & Rs to be submltted to staff for reVlew and approval prlor
to recordatlon
2 Payment of in lleu subd1vls10n fees be pald to the C1ty for
recreat10nal purpose~. The~e fees are to be pald for the
converSlon of the apartmcnt Unl ts 1 nto condoml nl urns.

5. Installatlon of automatlc garage door openers on all
ga rages.
6. Landscaplng plans to be subm1tted to the satlsfact10n of
the staff.
