RESOLUTION NO. 1092
.
A RESOLUTION OF THE SEAL BEACH PLA~NING
COMMISSION APPROVING A~D RECOMMENDING TO
CITY COUI~CIL APPROVAL OF TENTATIVE TRACT
MAP. NO. 10077.
WHEREAS, an applicatlon was duly flled by Montec1to Elght, a llmlted
partnershlp, 9461 Grandlay Street, Cyprcss for Tentat1ve
Tract 11ap No. 100]7, and
WHEREAS, the property lS descrlbed a<; Lot 1 , Tr1'ct No 9458 and lS
more commonly knOlm as 12510 r'lontecito Road, Sea 1 Beach;
and
WHEREAS, the proposal is to convert a n1ne unlt apartment buildln9
into a nlne unlt condomlnium ln the R-3 zone, and

WHEREAS, the Plannlng Commlssion makes the following flndings re-
gardlng the Tract Map'
1 The slte 1S physlcally suitable for development, the land
lS flat and lt lS located in a developed area Wltn eXlst-
lng streets, utlllties, resldences, and commerclal actlvltles
located adJacent to the proJect slte.
2. The slte is sUltable for the proposed denslty of development,
other proJects of simllar den~ity have been constructed and
are compat1ble with the area.
3. The deslgn of the subdlvislon wlll not cause substanclal
envlronmental damage.

4. The deslgn of the subd1vlslon is not llkely to cause serlOUS
public health problems because all the necessary utilit1es
and serVlces are available for the proJect.
5. The deslgn of the subdlvlslon 11111 not confl1ct wlth ease-
ments, acqulred by the public at large for access through,
or use of, property wlthln the proposed subdlvlsion ~ecause
no easements acqulred by the publlC at large are loc~ted on
the proJect slte.
6. The dlscharge of waste from the proposed subdiv1s10n lnto the
eXlstlng community seller system wlll not v10late eXlslAng
requlrements prescr1bed by the local regional watcr quality
control board pursuant to Dlvlslon 7 of the Water Code
7. No resldents wlll be dlsplaced by the proJect because no
unlts are occupled.
8. The proJect lS exempt from the provlslons of C.E.Q.A.
NOW, THEREFORE BE IT RESOLVED that the Plannlng Commls<;ion does hereby
approve Tentatl ve Tract Map No .10077 and recommends to Cl ty Councll approval
of the rract Map subject to the follow1ng condltlons.
1. C C & Rs to be submitted to staff for reV1ew and approval prlor
to recordatlon.
2. Payment of ln lleu subd1v1sfon fces be paid to the C1ty f0r
recreatlonal purposes. These fees are to be pa1d for the
conversion of the apartment unlts 1nto condom1nlums.

3. Installat10n of three new flre hydrants and upgradlng of
two existlng f1re hydrants to C1ty standards to the
satisfactlon of the Fire Chlef.
4. Installat10n of emergency access pass through gates ln
locatlons speclfled by the Flre Chlef 1n the rear wall.
5. Installat10n of automdtlc garage door openers on all
ga rages.
6. Landscap1ng plans to be submltted to the satlsfactlon of
the staff.
