A RESOLUTION OF THE SEAL BEAC~ PLANNING
COMMISSION APPROVING PLA~NED UNIT DE-
VELOPt1E~T, PUD-2-77 AND t~AKI~G RECO"t~EN-
OATIONS TO T~E REDEVELOP~ENT AGENCY
PEGAROING ARCHITECTURAL REVIEW OF THE
PROJECT AND RECOMMENDING TO CITY COUNCIL
CONDITIONAL APPROV~L OF PUD-2-77,
WHEREAS, an appllcatlon was duly fl1ed by East Naples Land Company
and the Clty of Seal Beach (Seal Beach Assoclates) 11
Marlna Drlve, Seal Beach, Callfornla for PUD-2-77, and
WHEREAS, the property lS descrlbed as a 5 acre parcel of land
bounded by San Gabrlel Rlver, Marlna Drlve, Flrst Street
and a portlon of the eXlstlng Seal Beach Traller Park,
Tentatlve Tract Map. No, 9783, portlons of ~P# 043-171-03,
043-173-10, commonly known as 11 Marlna Drlve; and

WHEREAS, the proposal lS for a Planned Unlt Development, PUD-2-77
for 80 townhouses and a recreatlonal complex ln the R-3
zone, and
WHEREAS, an Envlronmental Impact Report has been prepared on the
proJect and was determlned to be sufflclent by the En-
vlronmental Qual1ty Control Board on Septem~er 15, 1977;
and
WHEREAS, the proposal does not comply wlth the base zone setbacks
but does provlde usable open space ln a central green way
and does include recreatlonal amenltles ln the proJect;
and
WHEREAS, the Plannlng Commlss10n makes the followlng flndlngs re-
gardlng Planned lImt Development, PUD-2-77,
1, The proposed use lS consistent wlth the Clty'S General
Plan, Zonlng Ordlnance and Redevelopment Plan.
2. An Envlronmental Impact Report has been prepared for
thlS proJect WhlCh dld not reveal any maJor adverse lmpacts
WhlCh cannot be mltlgated.

3. The proJect lS over two acres ln Slze and lS, therefore,
ellg1ble for conslderatlon under a Planned Unlt Oevelopment
appllcatlon.
4. The proJect complles wlth the denslty, lot coverage,
helght, bulk and lntenslty prOV1Slons of the base zone when
calculated on a proJect wlde basls.
5. The proJect complles with the subdlvlslon requlrements
of the Clty.
6. All large trees ln the proJect area will be boxed and
replanted ln the flnlshed project where posslble.
7. The proposed recreatlonal complex lS adequate for the
Slze of the proJect.

NOW, THEREFORE BE IT RESOLVED that the Plannlng Comm1sslon does
hereby approve PUD-2-77 and recommends to the Redevelopment Agency
approval of the project as belng ln keeping w1th the goals of the
Redevelopment Agency Plan and lS archltecturally ln keeplng wlth
the Agency plan.
BE IT FURTHER RESOLVED that the Planning Commlsslon does hereby
approve and recommends approval to both the Redevelopment Agency
anc Clty Councl1 of PUD-2-77 subJect to the followlng condltlons.

2. The un1t setbacks be modlfled as follows:

The setback adJacent to Unlt No. 22 on Marlna Dr1ve
to be reduced from 15 ft. to 10 ft.
The setback adJacent to Unlt No.1 be modlfled from
zero to 3 ft.
The walkways between Un1ts 4 and 5 and Unlts 13 and
14 be lncreased from 5 ft. to 6 ft.
The setback adJacent to Unit No, 62 on Marina Drlve
be reduced from 15 ft. to 12 ft.
The setback adJacent to Lot No. 82 be lncreased from
4 ft, to 7 ft
The setback for unlts 62 through 82 on Flrst Street
be lncreased to an average of 18' wlth a mlnlmum of
a 15 ft. setback, wlth a 3' or greater reductlon ln
the wldth of the central greenway.
3. A mlnlmum of a 400 sq, ft. multl-purpose bUlldlng, plus
restrooms, a pool or a spa, and a patlo be prov1ded for the
use of all resldents of the development wlthin the townhouse
proJect.
4, The vehlcular turning radlus provlded to the garages should
comply wlth the prescrlbed intent of the Zonlng Ordlnance and
be to the satlsfactlon of the City staff, therefore the planters
ln the alleys should be ellmlnated or modlfled.
5. All garages shall be equlpped wlth authomatlc garage door
openers
6. All garages shall be a mlnlmum of 20 ft. ln depth (In-
terlor dlmenslon).
7. Guest park1nq spaces shall be strlped and the remalnder
of the proJect's streets and a 11 eys posted with "1'10 Parkl ng"
slgns.

8. Llghting lS to be provlded on garages, ln the greenway
and walkways to satlsfaction of the staff.
9. All eXlsting large trees to be boxed, where posslble, and
replanted ln the new development, to the satlsfactlon of the
staff.
10. Landscaplng plans shall be provided to the satlsfactlon of
the staff,

11. Emergency vehicle access to be provided at each end of the
central greenway to the satlsfactlon of the Flre Chlef.
12. Installatlon of flre hydrants (Clty East Bay Ranger Serles)
at locatlons speclfled by the Flre C~lef and to the satlsfactlon
of the Fl re Chl ef.
13. Installation of Class "C" roofs on all un1ts or as speclfled
by the Flre Chief,
14 Developer to attempt to obtaln a llcense from the Flood
Control Distrlct to provlde a 6 ft eMergency access way along
the property 11ne adJacent to the San Gabrlel Rlver
15 Patlo fences for the unlts adJacent to the San Gabrlel
Rlver shall not exceed a height of 42 lnches.
16. The Covenants, Condltlons and Restrlctlons for the proJect
shall be submltted to t~e staff and Clty Attorney for reVlew
and approval prlor to recordatlon.
17. Mall boxes shall be provlded ln compllance wlth U,S. Postal
Servlce.

18. Developer to comply wlth the accompanying englneerlng
conditlons, Exhlblt "A".
19, All wood sldlng above 15 feet ln helght to have one-hour
flre prooflng behlnd sldlng to the satlsfactlon of the Flre
Chlef.
20. Developer shall provlde a slltatlon and erOSlon control
program for the constructlon phase of the proJect.
21. A total of 80 townhouses to be bUllt and a recreatlonal
complex to be lnstalled.

Englneerlng Condltions
All on-slte and off-site water, se\'/er, stolln draln, street, street
llghtlng and utll1ty 1mprovement~ shall he constructed as requlrec
by the Clty Code and shall be to the satlsfactlon of the Clty
Engmeer, lncludlng but not llmlted to the follOlllng
1. Easements shall be provlded fo~ all on-s1te water facllltles
including water meters.
2. All condomlnium units and trailer spaces shall ~ave indlvldual
water meters.
3. All water facilitles shall be deeded to the C1ty.
4. Sewer serV1ce shall be mawtained to the existing development on
the south slde of Marina Dr1ve.
5. Ownershlp and malntenance of on-site sewers shall be the respon-
sibillty of the property owner.
6. Provlde a stub sewer connectlon to the right-of-way of !1anna
~rive wit1 sufflclent capaclty to serve future development on
the property bounded by the San Gabriel R1ver, ~arlna Dr1ve,
Flrst Street and the beach. Grant the rights to sald capaclty
to the Clty of Seal Beach.
7. Ellmlnate the present 48 lnch diameter pipe bottleneck at t~e
storm draln pump statlon.
8. Provide paved access to the pump statlon.
9. Provide a six foot hlg1 slump stone block wall along t~e present
fence lines of t~e pump stat10n adjacent to the trailer par~.
10. Provide a six foot hlgh galvanlzed metal slldlng ~ate at the
pump statlon access that wlll completely block ViSlbil1ty into
the faclllty.
11. Provi de an access gate between the pump statlon and t~e r1 ver
