HomeMy WebLinkAboutPC Res 1068 - 1977-07-06 . . RESOLUTION NO. 1068 . A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION RECOMMENDING TO CITY COUNCIL THAT APPEAL, A-2-77 BE DENIED. WHEREAS, an appl1cat1on was duly fl1ed by Owen Kupfer for Var1ance, V-8-77, and WHEREAS, the property lS descr1bed as Lots 12 and 14, Block 11, Bay Clty Tract and is more commonly known as 112 11th Street, and WHEREAS, the proposal is for a fence 1n the public r1ght-of-way WhlCh exceeds the maXlmum permltted height and does not comply with the v1sion clearance provis1ons at alley and street 1ntersectlons, and . WHEREAS, on Aprll 20, 1977 the Planning Commiss1on denied Var1ance, V-8-77 by Resolution No. 1059 on the basls that no hardsh1p eX1sts to warrant a fence of that hei9ht ln the public rlght-of-way which does not comply wlth the V1Slon clearance provisions at alley and street lntersectlons, and WHEREAS, the appllcant appealed the Plannlng Commlsslon's denlal of V-8-77 to the C1ty Councl1; and WHEREAS, on the basis of information contained ln a revised plot plan and a letter dated June 10, 1977, the City Council referred Appeal, A-2-77 back to the Plannlng Commisslon for a further report; and WHEREAS, on July 6, 1977, the Plannlng Commlssion considered the matter of Appeal, A-2-77. NOW, THEREFORE, BE IT RESOLVED that the Plannlng Commlssion does hereby report back to the City Councll that all the questions and pOlnts ralsed ln the June 10, 1977 letter have been satlsfactorlly answered by staff. There were, In 1974, Ordlnances regulating lmprovements In the publ1C r1ght-of-way, and limitlng fences ln the front yard setback to forty-two (42) inches 1n maXlmum helght and requlring vis10n clearance at alley and street intersections, The Plannlng Commission afflrms 1tS recommendatlons in Resolut1on 1059 and recommends to City Council that Appeal, A-2-77 be demed.
