RESOLUTIm' ":0. 1052 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION MAKING FINDIt;GS AND RECOM~1ENDATIONS REGARDING IMPROVEMENTS IN THE RIGHT-OF-WAY ADJACENT TO 801-805 OCEAN AVENUE WHEREAS, a request was recelved by two property owners at 801 and 805 Ocean Avenue for encroachments lnto the publlC rlght-of-way conslstlng of landscaplng, sprlnkler system and a low decor- atlVe wall; and WHEREAS, the Plannlng Comm1ss10n by Resolutlon 991 recommended that all fences be constructed on prlvate property, and WHEREAS, the Plannlng Commlsslon was of the oplnlon that speclal Clr- cumstances surrounded the subJect propertles for the followlng reasons: 1. There lS a Covenant on flle wlth the Clty that relieves the Clty of llablllty. . 2. The sldewalk on Ocean Avenue was reduced to ten feet due to a determlnatlon that a fourteen foot wlde foot wlde slde- walk was not requlred at that locatlon for pedestrlan purposes 3. The locatlon of the subJect propertles is unlque due to a publlC park across the street wlth hlgh pedestrlan trafflc 4. Sand blows up from the beach parklng lot and collects ln the landscaped area maklng lt dlfflcult to malntaln plants ln the planter. NOW, THEREFORE, BE IT RESOLVED that the Plannlng Commlsslon does hereby recommend approval of the proposed lmprovements ln the publlC rlght-of-way subJect to: 1. Recordatlon of a Covenant for a portlon of the publlC rlght-of-way on 8th Street by the property owner at 801 Ocean to allow the use of the publ1C rlght-of-way for landscaplng purposes lncludlng a low fence adJacent to the 8th Street sldewalk. . 2. Determlnatlon by the Clty Attorney that a low wall lS conslstent wlth permltted encroachments lnto the publlC rl ght-of-way. 3. Uetermlnatlon by the Clty Attorney that the proposed In- surance provlded by the property owners adequately relleves the Clty of 11ablllty. 4. Landscaplng plans to be approved by Staff.
