lot 1S not square. The opt10n 1S to demol1sh the front port1on of the house 1n
order to cause 1t to f1t on the lot. Th1s would cost approx1mately $100,000.
Therefore, they are seek1ng a var1ance. The only encroachment for a setback 1S 1n
the rear yard and that 1S fac1ng the house on C Row. The house was referenced to
the wrong slde yard and 1S presently off the foundat1on.
Comm1ss1oner Jessner asked 1f the eng1neer was asked to make a
to see 1f the mov1ng of the house would el1m1nate the setback.

Steve Roh, speak1ng 1n behalf of the Surfs1de Board of Olrectors. He would llke
to re1terate that the C1ty adamantly enforce no var1ances to Surfs1de. The Board
of D1rectors lS str1ctly aga1nst them.

Larry Peterson, speak1ng for Mr. Anderson, property owner of A6, Bl15 and C41. In
approx1mate1y June 1982, a survey was made of the property Bl15. The problem at
that t1me was very clarly spelled out. Th1s 1S not a hardsh1P case and 1S cons1stent
w1th the surveyor's map dated March 1971.

A. Report from Staff Regard1ng S1de Yard Encroachment at
133 12th Street
Mr. Johnson rev1ewed the Staff report glv1ng a br1ef background when the or1g1nal
appl1cat1on was rece1ved by the BU1ld1ng and Safety Department,-June 1983. The
perm1t was 1ssued after a plan check had been completed. Once the home was placed
on the lot, an adJacent res1dent comp1a1ned that the bU1ld1ng was greater than 19'
shown on the approved plans and the bU11d1ng was not properly pos1t1oned on the lot.
A survey was performed and showed that the bU11d1ng s11ght1y exceeded the 19' w1dth
and the encroachment 1nto the requ1red slde yard 1S sllght1y over 2t" at the north-
