RESOLUTION NUMBER 1605
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING AN
INDEFINITE EXTENSION OF CONDITIONAL USE
PERMIT 14-89, AN ON-SALE BEER AND WINE
LICENSE IN CONJUNCTION WITH AN EXISTING PUB
LOCATED AT 1500 PACIFIC COAST HIGHWAY, SEAL
BEACH (DAVE'S OTHER PLACE).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on September 18, 1989, Douglas Hoxeng filed an
application with the Department of Development services
for Conditional Use Permit (CUP) 14-89; requesting
approval to add his name to the existing liquor license
at Dave's Other Place, 1500 Pacific Coast Highway
(subject property). This CUP was the first issued to
the subject property; and
WHEREAS, On November 1, 1989 the Planning commission approved
CUP 14-89 through the adoption of Resolution No. 1558
(enclosed) subject to seven (7) conditions, one of
which (condition 7) required reconsideration of the
permit after twelve (12) months; and
WHEREAS, The subject property is located in the General
Commercial Zone (C-2), on the first floor of a two-
story office building at 1500 Pacific Coast Highway;
and
WHEREAS, The square footage of the bar is 904.75 feet, 596.85
sq. ft. of which is drinking and dining area for
patrons of the bar; and
WHEREAS, The occupant load of the bar is sixty-three (63)
people; and
WHEREAS, The subject property is utilized as a pub with three
(3) employees. Dave's Other Place serves sandwiches
and hot dogs in addition to beer and wine and the
interior includes a bar area, dining tables, a pool
table (licensed), and a table-top shuffle board game;
and
WHEREAS, The hours of operation are 8:00 a.m. to 12:00 a.m.
(midnight); and
WHEREAS, Dave's Other Place is classified by ABC as a "42"-
Public Premises, which is a bar, permitting on-sale
beer and wine only. Food may be served on the
premises, but minors are not allowed; and
WHEREAS, The following conditions are required by ABC of Dave's
Other Place:
a.) Hours of operation are 8:00 a.m. to 12:00 a.m.
(midnight) .
b.) No live entertainment or dancing.
c.) Music shall be audible only within the bar.
d.) The rear door shall be kept closed except during
emergencies and deliveries.
e.) No beer/wine may be consumed on the adjacent
premises.

The area surrounding the bar must be kept clean;
and
WHEREAS, William stearns, Chief of Police, has reviewed the
existing records, and has no reservations about
permitting the operation to continue; and
WHEREAS, The surrounding land use and zoning are as
follows:
North
Across Pacific Coast Highway are single
family dwellings in the Residential Low
Density, zone (RLD).
South
A mixture of single family and mUlti-family
dwellings in the Residential Medium Density,
zone (RMD).
East
& West
A mixture of commercial uses in the General
Commercial zone, (C-2); and
WHEREAS, a duly noticed public hearing was held on November 7,
1990 to consider and indefinite extension of CUP 14-89;
and
WHEREAS, the Planning commission makes the following findings:
1. The granting of CUP 14-89 is consistent with the
provisions of the General Plan which indicate the
subject property is to be used for general
commercial purposes.
2. The building and property at 1500 Pacific Coast
Highway are adequate in size, shape, topography
and location to meet the needs of the proposed use
of the property.
3. Required adherence to applicable building and fire
codes ensure there will be adequate water supply
and utilities for the proposed use.
4. The continuation of the use of the subject
property as a pub serving beer and wine on the
premises is compatible with the intended
commercial character of the Pacific Coast Highway
corridor. Adherence to conditions of approval
placed on the use by both the city of Seal Beach
and the Department of Alcoholic Beverage Control
should mitigate any negative impacts to
neighboring residential properties.
5. The Seal Beach Police Department has reviewed the
existing records of Dave's Other Place and has no
reservations regarding continuation of the use.
NOW, THEREFORE BE IT RESOLVED that the Planning commission of the
City of Seal Beach does hereby approve an indefinite extension of
CUP 14-89, subject to the following conditions:
1. An indefinite extension of CUP 14-89 is hereby approved a
CUP for on-sale beer and wine at 1500 Pacific Coast Highway,
Seal Beach (Dave's Other Place) and is issued to Douglas
Hoxeng and David J. Stangeland.

2. That all alcoholic beverages be consumed on the premises.
3. That the applicants shall comply with all restrictions
placed upon the license by the state Department of Alcoholic
Beverage Control.
4. That CUP 14-89 is non-transferable.
5. That there shall be no alcoholic beverage advertising
display devices located in the window areas.
6. That with the applicant's consent, the hours of operation
shall be from 8:00 a.m. to 12:00 a.m. (midnight).
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
city of Seal Beach at a meeting thereof held on the 7th day of
November, 1990, by the following vote:
