" RESOLUTION NUMBER 1601 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONING TEXT AMENDMENT (ZTA) 7-90, AMENDING SECTIONS 28- 500 THROUGH 28-506 AND 28-600 THROUGH 28-604 OF THE CODE OF THE CITY OF SEAL BEACH TO PROVIDE SPECIFIC DEVELOPMENT STANDARDS FOR THAT PORTION OF THE SOUTHERN PACIFIC RIGHT- OF-WAY WITHIN THE SURFSIDE COLONY. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, at its October 3, 1990 meeting the Planning Commission recommended approval of General Plan 2A-90, General Plan Amendment 2B-90 and Zone Change 1-90 to the city Council; and WHEREAS, General Plan Amendment 2A-90, General Plan Amendment 2B-90 and Zone Change 1-90 changed the zoning of the westerly 25 feet of the Southern Pacific right-of-way from S-P Parking to Residential Low Density; and WHEREAS, through its review of General Plan 2A-90, General Plan Amendment 2B-90 and Zone Change 1-90, staff felt the following concerns should be addressed: 1. In conjunction with the increase in lot size, each individual property owner must be limited from further subdivision of the property at some future date. 2. The text of Sections 28-500 through 28-506 and Sections 28-601 through 28-604 of the Code of the citv of Seal Beach must be amended to provide specific development standards for parcels B-1 through B-70. Such standards should include a specific minimum lot size, density requirement, parking requirements, setbacks and height requirements; and WHEREAS, staff has prepared an initial environmental assessment and proposed Negative Declaration as required by the California Environmental Quality Act (CEQA). Staff received comments back from several governmental entities, each expressing "no concern" with the proposed project; and WHEREAS, a duly noticed public hearing was held on December 5, 1990 to consider ZTA 7-901 and WHEREAS, the Planning Commission makes the following findings: 1. The proposed zoning Text Amendment and accompanying Zone Change and General Plan Amendments will not increase the number of lots within the Surfs ide Colony. The affected lots are presently utilizing the southerly 25 feet of the S-P right-of-way for Residential Low Density uses, namely detached garages and rear yards. 2. The proposal will not increase the density of development within Surfside. 3. As conditioned by staff, the proposal will result in a more orderly use of the affected lots. C'\KP50\l~\Z~AgO--7.RBS . . As conditioned by staff, this proposal will, over time, result in safer conditions for pedestrians, bicyclists and motor vehicles along surfside Avenue. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby recommend approval of ZTA 7-90 to the City Council, subject to the following conditions: Section 1. Article 5. Subsection (4) of Section 28-505 of Chapter 28 of The Code of the citv of Seal Beach is hereby amended to read: "(4) Parking type: Garage or Carport. (a) Block B, Anderson street (Lot 1) northwesterly to Seal Way (Lot 70) future development: Upon development or redevelopment of said properties, or in the discretion of the Planning Commission with respect to Minor Plan Reviews, all parking shall be located off of the rear alley." Section 2. Article 5. Subsection (5) of Section 28-506 of Chapter 28 of The Code of the Citv of Seal Beach is hereby added to read: "(5) Specific development standards for Block B, Anderson street (Lot 1) northwesterly to Seal Way (Lot 70). In addition to the existing requirements of this chapter the following development standards shall apply: (a) Minimum Lot Size ................25 ft. x 60 ft." Section 3. "Existing Subsections (5) through (8) of Section 28-506 of Chapter 28 of The Code of the Citv of Seal Beach are hereby renumbered (6) through (9), respectively." Section 4. Article 6. Section 28-601 of Chapter 28 of The Code of the citv of Seal Beach is hereby amended read: "Uses Permitted (1) Private roads. (2) Parking Lots." Section 5. Article 6. Sections 28-602, 28-603 and 28-604 of Chapter 28 of The Code of the citv of Seal Beach are hereby removed in their entirety. Section 6. Article 6. Section 28-503 of Chapter 28 of The Code of the citv of Seal Beach is hereby amended to read: "Buildina Heiqht Limit. Maximum building height for residential structures shall be thirty-five (35) feet, as C=\WP50'1~\I~ID--1.RB8 . . . . Planning commission Res. No. 1601 Page 3 of 3 measured from the crown of Surfs ide Avenue at the center of the subject property." PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 5th day of December, 1990, by the following vote: AYES: Commissioners Fife. Shar~.
