RESOLUTION NUMBER 1600 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONE CHANGE 1-90, CHANGING THE ZONING OF THE SOUTHWESTERLY PORTION OF THE SOUTHERN PACIFIC RIGHT-OF-WAY WITHIN THE SURFSIDE COLONY FROM S-P PARKING ZONE, (S-P) TO RESIDENTIAL LOW DENSITY, (RLD). THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On July 9, 1990 surfside Colony, Ltd. filed an application with the Department of Development Services for Zone Change 1-90 and General Plan Amendments 2A-90 and 2B-90, requesting to merge each privately owned lot with that portion of the right-of way adjacent to the existing residential lots and change the zoning of the affected portion of the right-of-way from S-P Parking zone, (S-P) to Residential Low Density zone, (RLD); and WHEREAS, the Southern Pacific right-of-way traverses the City of Seal Beach in roughly an east-west direction; and WHEREAS, within the Surfside Colony the right-of-way is presently utilized for the private garages of single- family homes adjacent to the right-of-way, the alley adjacent to Pacific Coast Highway and for the Surfside Colony community parking lot; and WHEREAS, Staff has prepared an initial environmental assessment and proposed Negative Declaration as required by the California Environmental Quality Act (CEQA). Staff received comments back from several governmental entities, each expressing "no concern" with the proposed project, and WHEREAS, a duly noticed public hearing was held on October 3, 1990 to consider Zone Change 1-90; and WHEREAS, the Planning Commission makes the following findings: 1. The proposed Zone Change and accompanying Zoning Text Amendment and General Plan Amendments will not increase the number of lots within the Surfside Colony. The affected lots are presently utilizing the southerly 25 feet of the S-P right-of-way for Residential Low Density uses, namely detached garages and rear yards. 2. The proposal will not increase the density of development within Surfside. 3. As conditioned by staff, the proposal will result in a more orderly use of the affected lots and provide for a decreased lot coverage of the affected lots and an increase in private open space on said lots. 4. As conditioned by staff, over time the proposal will result in a safer conditions for pedestrians, bicyclists and motor vehicles along Surfs ide Avenue. No. 1600 Page 2 of 2 THEREFORE BE IT RESOLVED that the Planning Commission of the of Seal Beach does hereby recommend approval of Zone Change to the city Council, subject to the following conditions: Zone Change 1-90 is hereby approved changing the zoning on the southerly 25 feet of the Southern Pacific right-of-way between Block B, Anderson street (Lot 1) and Block B, Seal Way (Lot 70) from S-P Parking zone, (S-P) to Residential Low Density. In conjunction with the proposed lot line adjustments, the applicant shall provide the City with a Record of Survey of all affected properties and affected survey boundaries. said Record of Survey shall be utilized by the Engineering Department in conditioning the proposed lot line adjustments. Boundary markers shall be placed for each affected property in conjunction with the abovementioned Record of Survey. The second reading of this proposed ordinance (Zone Change 1-90) shall take place in conjunction with the second reading of the ordinance approving Zoning Text Amendment 7- 90. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 3rd day of October, 1990, by the following vote: AYES: Commissioners Fife. SharD.
