RESOLUTION HUMBER 1596
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 10-90, A REQUEST TO CONVERT A TWO
(2) UNIT APARTMENT INTO CONDOMINIUMS AT 1120
CENTRAL AVENUE.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on July 26, 1990, Bruce M. Stark filed an application
with the Department of Development Services for
Conditional Use Permit 10-90, a request to convert a
two (2) unit apartment into condominiums at 1120
Central Avenue; and
WHEREAS, the subject property is flat topographically and nearly
square in shape measuring 50' x 55' (2,750 square
feet); and
WHEREAS, the subject property is located on Central Avenue, 92~
feet west-northwest of the centerline of 12th Street
and consists of a three-story, two-unit apartment
currently under remodel; and
WHEREAS, the subject property is legally described as portions
of Lots 45 and 47, Block 11, of the Bay City Tract as
shown in a map recorded in Book 3, Page 19, of
Miscellaneous Maps, Records of county of orange,
California; and
WHEREAS, as set forth in ~28-2322(D)(I)(b) of the Code of the
citv of Seal Beach, City Building and Planning staff
have inspected the site on numerous occasions in
conjunction with the current remodel and determined the
site meets all applicable Building and Zoning
requirements, save density; and
WHEREAS, Section 28-2322(C) of the QQgg requires multiple family
units proposed for condominium conversion conform to
all applicable zoning standards, excluding density: and
WHEREAS, the subject property received CUP 4-89 allowing a major
remodel and addition to a nonconforming duplex which
was nonconforming solely due to density; and
WHEREAS, The surrounding land uses and zoning are as follows:
A mixture of single-family and multi-
family dwellings in the Residential High
Density zone, (RHD); and
WHEREAS, the Planning commission held a duly noticed public
hearing on September 19, 1990 and voted to approve CUP
10-90: and

WHEREAS, the Planning Commission makes the following findings:
1. The proposed conversion of two apartments into
condominiums at 1120 Central Avenue complies with
the provisions of ~ Section 28-2322.
2. The proposal is consistent with applicable zoning
requirements and the General Plan.
3. The conditions imposed by the Building,
Engineering, Fire and Recreation Departments will
ensure the project poses no serious health or

safety problems.
NOW, THEREFORE BE IT RESOLVED that the planning Commission of the
city of Seal Beach does hereby approve Conditional Use Permit 10-
90, SUbject to the following conditions:
1. Conditional Use Permit 10-90 is approved for the conversion
of a two (2) unit apartment building into two (2)
condominiums at 1120 Central Avenue.
2. Security lighting, dead bolt locks and window locks shall be
provided on the subject property in a manner approved of by
the Department of Development Services.
3. Prior to final map approval, the applicant shall address any
and all required corrections to the CC&R's and submit back
to the city revised CC&R's incorporating said corrections.
4. The applicant shall comply with any and all conditions
forthcoming from the Orange County Fire Department through
its review of the proposed Tentative Parcel Map.
5. Each dwelling unit shall be provided with separate utility
meters and utility lines (gas, electric and telephone).
6. The applicant shall relocate the fire hydrant to provide a
minimum clearance of two feet from the beginning of the full
height curb, if determined to be necessary by the Department
of Public Works upon further review. This condition will
become effective in 120 days.
7. The applicant shall remove any walls or permanent structures
located within the the planted area along the property's
northerly boundary from the public right-of-way unless the
applicant obtains an encroachment permit. This condition
will become effective in 120 days.
8. No structure shall be constructed within the four (4) foot
wide easement described in Note A of Tentative Parcel Map
90-332.
9. All taxes for the fiscal year 1990-91 shall be paid in full,
and evidence of payment provided upon submittal of the Final
Parcel Map.
10. The applicant shall provide written notice within ten (10)
days of approval of the final map for the proposed
conversion to any and all tenants residing at the subject
property at said time.
11. Prior to approval of the final map, the applicant shall
provide the City with written proof that each new tenant of
the subject property has received written notice of the
proposed condominium conversion prior to becoming a tenant.
Such proof shall be in the form of a statement, signed and
dated by the tenant on or before the signing of the rental
agreement, stating their knowledge of the proposed
conversion.
PASSED, APPROVED AND ADOPTED by the planning Commission of the
City of Seal Beach at a meeting thereof held on the 19th day of
