RESOLUTION NUMBER 1592 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT (CUP) 12-89, APPROVING A REQUEST FOR THE PLACEMENT OF TWELVE (12) COIN- OPERATED AMUSEMENT DEVICES WITHIN THE LOBBY OF WITHIN A THEATRE (SUPER SAVER CINEMA SEVEN) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, the Super Saver Cinema Seven Theatres, Inc. is owned by Associated Theatres, Inc. and Lyco Financial, Inc.; and WHEREAS, the subject property is located within the Rossmoor Business Center and is surrounded on all sides by said Center: and WHEREAS, the first floor area, consisting of the lobby, restrooms, concession and storage areas, and all seven (7) theatres encompasses an area of approximately 23,577 square feet. The lobby measures approximately 4,410 square feet in area; and WHEREAS, the subject property possesses a valid City business license for the operation of a theatre; and WHEREAS, a duly noticed public hearing was held on September 20, 1989 to consider CUP 12-89 at which the Planning commission approved the request for a period of six (6) months (this period was subsequently reviewed and extended for an additional six (6) months). Approval was subject to eight (8) conditions and contained a five step "video area control method": and WHEREAS, a duly noticed pUblic hearing was held on October 3, 1990 to consider an extension of CUP 12-89. In conjunction with this review, the Commission requested a review of the escalating police problems associated with the theatre: and WHEREAS, the Planning Commission makes the following findings: 1. The extension of CUP 12-89 is consistent with the provisions of the General Plan which indicate the subject property is to be used for general commercial uses. 2. The subject property is adequate in size, shape, topography and location to meet the needs of the proposed use of the property. Specifically, the lobby area is of adequate size and is accessible only through the purchase of a theatre admission to ensure proper usage of the video gaming area. 3. Required adherence to applicable building and fire codes ensure there will be adequate water supply and utilities for the proposed use. 4. Required adherence to the conditions of approval as well as the "video area control method" will ensure proper usage of the video gaming area. C.\1fP60\CUP\CUPB!iI-12 RS2 . . Planning Commission Res. No. 1592 Page 2 NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the city of Seal Beach does hereby approve a six (6) month extension of CUP 12-89, subject to the following conditions: 1. CUP 12-89 is extended for a six (6) month period of time. 2. That persons shall be allowed to play the machines after the purchase of a theatre admission ticket. control method shall be developed by the owner and by staff (enclosed as Attachment A). only The exact approved 3. That the video game machines be turned off upon the closing of the ticket booth for the final shows of the evening, at approximately 10:30 p.m. 5. That the on-duty manager of the theatre shall monitor the video game area to prevent the loitering of individuals in the lobby. 6. That the business amusement devices process. license fee for the coin-operated be paid to complete the application 7. That with the applicant's consent, the hours of operation shall be between 12:00 p.m. (noon) and 12:00 a.m. (midnight) for the public and between 9:00 a.m. and 12:00 a.m. (midnight) theatre employees. 8. That no person shall be permitted to play the coin-operated amusement devices during hours when any public or private school is in regular session in the cities if Seal Beach, Los Alamitos or the unincorporated area known as Rossmoor unless such person's age is 18 years or more. The theatre manage shall require proper identification in cases of doubt. 9. A sign, not less than three (3) square feet in area, shall be clearly posted at the video game machine area stating that use of the machines is limited to holders of tickets for a theatre performance on the premises. 10. A sign, not less than six (6) square feet in area, shall be clearly posted at the video game machine area stating that use of the machines is not permitted by persons under the age of 18 years during hours when any public or private school is in regular session in the cities if Seal Beach, Los Alamitos or the unincorporated area known as Rossmoor unless such person's age is 18 years or more. The theatre manage shall require proper identification in cases of doubt. 11. CUP 12-89 is shall be reviewed after six (6) months to determine whether the increased Police patrol has resolved the loitering problem outside of the theatre. If the problem still exists at that time the Planning Commission may require the theatre to provide an on-site security officer at hours deemed appropriate by the Commission. ATTACHMENT A PROPOSED CONTROL METHOD FOR UTILIZATION OF VIDEO GAME AREA AT SUPER SAVER CINEMA SEVEN 1) Completely rope off the game machine area with an opening. 2) The opening shall be controlled by an employee at all times that the games are in use. 3) Said employee shall to restrict use of machines to patrons that have purchased a theatre admission ticket. 4) All video games are to be turned off when the box office is closed, normally 15-30 minutes after the last show begins and no later than 10:20 p.m. under any circumstances. 5) No one under the age of 18 will be allowed to play the video games while school is in session, and a sign shall so state. . .
