HomeMy WebLinkAboutPC Res 1587 - 1990-07-18 r ' . . . - - RESOLUTION NUMBER 1587 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING CONDITIONAL USE PERMIT 6-90, A REQUEST FOR AN OFF-SALE BEER AND WINE LICENSE IN CONJUNCTION WITH AN EXISTING AUTOMOBILE SERVICE STATION AT 490 PACIFIC COAST HIGHWAY. (ARCO) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On April 25, 1990, Oahn Q. Do filed an application with the Department of Development Services for Conditional Use Permit 6-90, a request to for an off-sale beer and wine license in conjunction with an existing automobile service station at 490 Pacific Coast Highway: and WHEREAS, The subject property is located at the corner of Pacific Coast Highway and Fifth Street, Orange County Assessor's Parcel Number 43-301-2: and WHEREAS, The surrounding land uses and zoning are as follows: NORTH & SOUTH Across Pacific Coast Highway and directly behind the subject property are single family homes in the Residential Low Density zone, (RLD). EAST & WEST Commercial Uses in the General Commercial zone, (C-2): and WHEREAS, William Stearns, Chief of police, has reviewed the existing records and the proposed use of the site and has reservations about permitting the sale of beer and wine at the site: and WHEREAS, The City has received, through three separate letters, the protests of 13 local residents to the issuing of Conditional Use Permit 6-90 : and WHEREAS, The Planning Commission held a duly noticed public hearing on July 18, 1990 and voted to deny Conditional Use Permit 6-90: and the Planning commission makes the following findings: 1. The use is inconsistent with the uses permitted for an automobile service station as set forth in ~28-2318 of the Code of the Citv of Seal Beach. The proposed use would violate the Zoning ordinance and therefore adversely affect the General Plan. 2. The proposed sale of beer and wine for off- premises consumption will violate the City'S code, place two off-sale alcohol establishments directly adjacent to each other, locate another off-sale alcohol establishment in a high crime area and encourage the practice of drinking and driving. NOW, THEREFORE BE IT RESOLVED that the Planning commission of the City of Seal Beach does hereby deny Conditional Use Permit 6-90.
