RESOLUTION NUMBER 1585
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 8-90, A REQUEST TO TRANSFER AN
EXISTING OFF-SALE GENERAL LIQUOR LICENSE IN
CONJUNCTION WITH THE TRANSFER OF OWNERSHIP OF
AN EXISTING LIQUOR STORE AT 412 MARINA DRIVE
(IRVINE LIQUOR).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, On June 6, 1990, Elias Azar filed an application with
the Department of Development Services for Conditional
Use Permit 8-90, a request to transfer an existing off-
sale general liquor license in conjunction with the
transfer of ownership of an existing liquor store at
412 Marina Drive (Irvine Liquor): and
WHEREAS, The subject property is located at the corner of Marina
Drive and Fifth Street, consisting of a four unit
single story commercial center, of which the
convenience store (liquor store) is the largest of the
four units: and
WHEREAS, A staff inspection of the site on July 11, 1990,
revealed several alcoholic beverage advertisements
located in the windows of the site, an unpermitted sign
advertising copies: and
WHEREAS, The current use of the property is a convenience store
that sells alcoholic beverages: this conditional use
permit is required because the license is being
transferred to a new owner: and
WHEREAS, The surrounding land uses and zoning are as follows:
NORTH
Across Marina Drive are single family
homes in the Residential Low Density
zone, (RLD).
SOUTH & WEST
Residential uses in the Residential High
Density zone, (RHD).
EAST
Across Fifth Street is a church in the
General Commercial zone, (C-2) and
residential uses in the RHD zone: and
WHEREAS, William Stearns, Chief of police, has reviewed the
existing records, and has no reservations about
permitting the operation to continue: and
WHEREAS, the Planning Commission held a duly noticed public
hearing on July 18, 1990 and voted to approve CUP 8-90:
and
WHEREAS, the Planning commission makes the following findings:
1. The continued service of off-sale general liquor
at 412 Marina Drive will not adversely impact the
surrounding neighborhood. The subject property
had possessed an off-sale general liquor license
for several years with no reported impacts.
2. The off-sale general liquor is appropriate for the
existing convenience/liquor store on the subject
property.

NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
city of Seal Beach does hereby approve Conditional Use Permit 8-
90, subject to the following conditions:
1. CUP 8-90 is approved for an off-sale general liquor
license at 412 Marina Drive, and is issued to Elias
Azar.
2. CUP 8-90 is non-transferrable.
3. No alcoholic beverage advertising or display devices
shall be located in the window areas and outside of the
store.
4. with the applicant's consent, the hours of operation
shall be 6:00 a.m. to 11:00 p.m. Sunday through
Thursday, and 6:00 a.m. to 12:00 a.m. Friday and
Saturday.
5. The applicant shall comply with all restrictions placed
on the license by the California Department of
Alcoholic Beverage Control.
6. No video games or similar amusements shall be permitted
on the premises.
7. The term of this permit shall be twelve (12) months,
after which time the Planning Commission shall review
and may extend the permit indefinitely provided that
all conditions of approval have been satisfied and no
significant police problems have occurred.
8. Approval of Conditional Use Permit 8-90 shall become
effective only upon the Planning Department's written
verification that the applicant is in full compliance
with the aforestated seven (7) conditions.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
city of Seal Beach at a meeting thereof held on the 18th day of
July, 1990, by the following vote:
