RESOLUTION No. 1576
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH RECOMMENDING APPROVAL
OF AN AMENDMENT TO THE HELLMAN SPECIFIC PLAN.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
ORDAIN:
WHEREAS, a request was filed by Mola Development Corporation to
amend the existing Hellman Specific Plan prepared and
adopted in December of 1987; and
WHEREAS, the city Council adopted Ordinance No. 1258 which
covers the establishment, policies, regulations, and
processing of the Specific Plan; and
WHEREAS, responsible agencies that govern the enhancement,
restoration, or maintenance of wetlands have determined
that a wetlands of approximately 41.4 acres should be a
part of this Specific Plan area; and
WHEREAS, an amendment of the Specific Plan is needed to locate
this wetlands resource and provide a description; and
WHEREAS, this amendment is consistent with the goals and
policies of Chapter 3 of the California Coastal Act of
1976; and
WHEREAS, the Planning Commission considered this item at a duly
noticed Public Hearing held on May 9, 1990; and
WHEREAS, the Environmental Impact Report and the Supplemental
Environmental Impact Report demonstrate the proposed
amendment to the Hellman Specific Plan will have no
significant impact on the environment that will not be
mitigated to a leyel of insignificance; and
WHEREAS, the Planning commission of the city of Seal Beach has
facilitated public participation in the preparation of
this amendment to the Hellman Specific Plan by inviting
public participation at its duly noticed Public Hearing
on May 9, 1990, and considered the views of speakers at
that meeting through both written and oral evidence,
before adopting Resolution No. 1576; and
WHEREAS, this Commission has reviewed and considered the
proposed amendment to the Hellman Specific Plan and
conducted a duly noticed Public Hearing on May 9, 1990,
at which time both written and oral evidence was
received; and

WHEREAS, the city has reviewed the existing text of the Hellman
Specific Plan and the text of the General Plan and
determined that the proposed amendments to the Hellman
specific Plan are consistent with the letter and spirit
of the existing Hellman Specific Plan and the General
Plan.
NOW THEREFORE THE PLANING COMMISSION HEREBY FINDS, RESOLVES AND
DETERMINES AS FOLLOWS:
1. The proposed wetlands was described in the Program
EIR, and a mitigation measure required the project
proponent to consult with agencies responsible for
wetlands restoration. Those agencies have
recommended that on-site wetlands restoration be
carried out on the proposed site to encompass 41.4
acres.
2. The California Coastal Commission has approved the
"Hellman Property Wetland Restoration Plan," as
revised March 8, 1990.
3. The changes to the specific Plan reflecting the
addition of the wetlands do not conflict with the
established pOlicies or regulations of the
Specific Plan or the goals, objectives, or
policies of the General Plan.
4. Pursuant to section 15168 of the CEQA Guidelines,
a program EIR (87-1) has been prepared and
certified by the city of Seal Beach, and this
amendment is within the scope of the certified
program EIR.
5. A Supplemental EIR has been prepared and certified
by the City of Seal Beach which adequately
describes the general environmental setting of the
project, its significant environmental impacts,
and the alternatives and mitigation measures
related to each significant environmental effect,
and no additional environmental documentation is
needed.
6. The Planning commission of the City of Seal Beach
finds that the adoption of the proposed amendment
to the Hellman Specific Plan on file in the Office
of the city Clerk, attached hereto as "Exhibit A",
and incorporated herein by this reference, will
not have a significant impact on the environment
that will not be mitigated to a level of
insignificance as provided in the EIR and
Supplemental Environmental Impact Report prepared
for this project, attached hereto as "Exhibit B",
and incorporated herein by this reference.

7. The Planning Commission of the City of Seal Beach
finds that the proposed amendment to the Hellman
Specific Plan has been prepared according to all
procedures set forth in the city Code and all
applicable provisions and of the Government Code
and that the terms of the Hellman Specific Plan as
amended by this proposal comply with the
requirements of the Code of the City of Seal Beach
and any applicable sections and applicable
portions of the Government Code.
8. The city Council of the City of Seal Beach finds
that the proposed amendment to the Hellman
Specific Plan is in the public interest, is
consistent with the land use goals of the City as
set forth in the existing Land Use Element, and
that the uses proposed for the affected parcels
are compatible with the present uses of
neighboring parcels.
9. The city Council of the City of Seal Beach finds
that the Hellman specific Plan as amended by this
proposal is consistent with the General Plan of
the City of Seal Beach, including the Housing
Element, as proposed by staff, and by the Planning
Commission.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the city of Seal Beach does hereby approve the amended Hellman
Specific Plan for the Hellman Ranch area, as shown in Exhibit "A"
attached, subject to the changes enclosed as Attachment "A".
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
city of Seal Beach at a meeting held on the 9th day of May, 1990,
by the following vote:
AYES: Commissioners Rullo. Fife, McCurdY. Share.
ABSTAIN: Commissioner Forsythe.
NOES: Commissioners
