HomeMy WebLinkAboutPC Res 1569 - 1990-03-07 , . . - RESOLUTION HUMBER 1569 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 2-90, A REQUEST TO TRANSFER AN EXISTING OFF-SALE GENERAL LIQUOR LICENCE IN CONJUNCTION WITH THE TRANSFER OF OWNERSHIP OF AN EXISTING LIQUOR STORE AT 12101 SEAL BEACH BOULEVARD, SEAL BEACH. (CARRIAGE TRADE LIQUOR) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On January 16, 1990, Gopal Seth filed an application with the Department of Development Services for Conditional Use Permit 2-90, to transfer an existing off-sale general liquor licence in conjunction with the transfer of ownership of an existing liquor store at 12101 Seal Beach Boulevard, Seal Beach. (Carriage Trade Liquor); and WHEREAS, The subject property is located at the extreme northerly end of the Rossmoor Business Center, roughly at the southwest corner of Seal Beach Boulevard and Bradbury Drive; and WHEREAS, The current use of the property is a convenience store that sells alcoholic beverages; this conditional use permit is required because the license is being transferred to a new owner. Staff records indicate that this will be the first CUP for this site, however; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH A gasoline service station in the General Commercial zone, (C-2) and single family residences located within the City of Los Alamitos. SOUTH The Rossmoor Business Center in the General Commercial zone, (C-2). Single family residential uses located within the city of Los Alamitos. High density residential uses located within the City of Los Alamitos.: and EAST WEST WHEREAS, William Stearns, Chief of Police, has reviewed the existing records, and has no reservations about permitting the operation to continue: and WHEREAS, A duly noticed public hearing was held on March 7, 1990. NOW, THEREFORE BE IT RESOLVED that the Planning commission of the City of Seal Beach does hereby approve Conditional Use Permit 2- 90, subject to the following conditions: 1. CUP 2-90 is approved for an off-sale general liquor license at 12101 Seal Beach Boulevard, and is issued to Gopal Seth. # . . City of Seal Beach Planning Commissioft Resolution 1569 Page 2 of 2 2. CUP 2-90 is non-transferrable. 3. No alcoholic beverage advertising or display devices shall be located in the window areas and outside of the store. 4. with the applicant's consent, the hours of operation shall be 6:00 a.m. to 12:00 a.m. (midnight) Sunday through Thursday and 6:00 a.m. through 1:00 a.m. Friday and Saturday. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. No video games or similar amusements shall be permitted on the premises without the obtainment of proper permits from the City. 7. The term of this permit shall be twelve (12) months, after which time the Planning Commission shall review and may extend the permit indefinitely provided that all conditions of approval have been satisfied and no significant police problems have occurred. 8. CUP 2-90 is approved with the understanding that at the twelve month review of the CUP, the Planning Commission may integrate additional conditions relative to recycling. PASSED, APPROVED AND ADOPTED by the Planning commission of the city of Seal Beach at a meeting thereof held on the 7th day of March, 1990, by the following vote: AYES: Commissioners SharD. Rullo.
