RESOLUTION NUMBER 1568
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING VARIANCE
8-89, A REQUEST FOR LESS THAN THE REQUIRED
ON-SITE PARKING IN CONJUNCTION WITH THE
ADDITION OF 440 SQUARE FEET OF DEDICATED
STORAGE SPACE TO THE SECOND STORY OF AN
EXISTING TWO-STORY MIXED USE COMMERCIAL
STRUCTURE AT 101 MAIN STREET, SEAL BEACH
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:

WHEREAS,
On July 5, 1989, James R. Watson submitted an application for
Variance 8-89 to the Department of Development Services; and
The Planning Commission considered Variance 8-89 on August 16,
1989, and tabled the request for one year, allowing staff adequate
time to research and formulate a formal parking program for Old
Town; and
On January 12, 1990, the applicant reduced his requested addition
from 1,425 square feet to 440 square feet. Further, the applicant
is proposing the addition be dedicated storage space located on
the second story along the property's southerly side; and
The subject property contains approximately 11,000 square feet and
is located at the northwestern corner of Ocean Avenue and Main
Street (101 Main Street); and
The subject property has approximately 100 feet of frontage Ocean
Avenue and 110 of frontage on Main Street; and
The subject property currently contains a mixture of commercial
uses; and
The subject property has received the following approvals from the
Planning Commission:
A. CUP lO-76 for on-sale beer and wine in conjunction with an
Italian restaurant.
B. Plan Review 2-77 approving a sign program.
C. SPR 22-77 for the above mentioned sign program.
D. VAR 1-77 for architectural projections into the front
setback.
E. CUP 7-80 for on-sale beer and wine at Giancola's restaurant.
F. CUP 4-82 to transfer the above mentioned on-sale beer and
wine license.
G. MUD 2-84 to allow for a minor height variance for an
architectural projection; and
The surrounding land use and zoning are as follows:
NORTH & EAST
Mixed commercial uses in the Service Commercial
(C-l) Zone.
SOUTH
Eisenhower Park and the City beach in the Public
Land Use zone, (PLU).

A commercial office building in the Service
Commercial zone, (C-l), and a mixture of multi-
family and single family residential dwellings
in the Residential High Density zone, (RHO); and
WHEREAS,
Main Street and Ocean Avenue are secondary streets developed to
their ultimate rights-of-way of 80 feet; and
WHEREAS,
On February 21, 1990, the Planning Commission held a duly noticed
Public Hearing to consider Variance 8-89; and
WHEREAS,
The Planning Commission makes the following findings:
1. Variance 8-89 will not adversely affect the General Plan
which designates the subject property for commercial uses.
2. There are special property related circumstances which
deprive the property at 101 Main Street of the privileges
enjoyed by other property in the same vicinity and zone.
Specifically, the size and shape of the property and the
manner, in which it was developed prevent the provision of
any additional parking spaces on the site.
3. The granting of Variance 8-89 will not constitute a grant of
special privilege inconsistent with other limitations upon
other properties in the same vicinity and zone.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance 8-89, subject to the following conditions:
1. Variance 8-89 is approved for the provision of less than the required
on-site parking; in conjunction with the addition of 440 square feet of
dedicated storage space to the second story of an existing two-story
mixed use commercial structure at 101 Main Street, Seal Beach.
2. That a covenant be recorded on the title of the property which
permanently dedicates the 440 square foot addition to storage purposes.
3. That all requirements of the Uniform Building Code be met prior to
occupancy.
4. All construction shall be in substantial conformance with the plans
submitted, except as conditioned by the Planning Commission.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal
Beach at a meeting thereof held on the 21st day of February, 1990, by the
following vote:
