HomeMy WebLinkAboutPC Res 06-20 - 2006-06-07 RESOLUTION NUMBER 06-20 ORIGINAL A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 06-5, APPROVING A BBQ AND COUNTER STRUCTURE IN THE REAR AND SIDE YARD SETBACK AREAS AT 3580 ASTER STREET, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section I On Apnl 17, 2006, Wanda and Dan Crowley ("The Apphcants") filed an apphcatlOn for Mmor Plan ReVIew 06-5 With the Department of Development Services Through MPR 06-5, the apphcant sought to construct a 48-mch hIgh BBQ and counter structure m the 10 feet rear setback area and m the 5 feet SIde setback area at 3580 Aster, Seal Beach SectIon 2 Pursuant to 14 Cahf. Code of Regs. ~ 15025(a) and ~ IJ,B of the CIty'S Local CEQA GUidelines, stafThas determmed as follows: The applicatIOn for Mmor Plan ReView 06-5 IS categorically exempt from review pursuant to the CalifornIa Envlromnental Qualtty Act pursuant to 14 Calif. Code of Regs ~ 15303 NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES (a) single-famIly residences not m conJunction wIth the buildmg of two or more such umts In urbanized areas, up to three smgle-famlly resIdences may be constructed or converted under thIS exemption. ~ 15061(b)(3), because It can be seen With certamty that there IS no pOSSIbIlity that the approval may have a SIgnificant effect on the environment SectIOn 3 A duly notIced hearing was held before the Planmng CommisSIon on June 7,2006 to consider the applical10n for Mmor Plan ReVIew 06-5, SectIOn 4 The record of the hearmg on June 7, 2006 mdIcates the followmg (a) On Apnl 17, 2006, Wanda and Dan Crowley ("The Applicants") filed an applicatIon for Mmor Plan ReView 06-5 With the Department of Development Services. (b) SpecIfically, the request IS to construct a 48 mch hIgh BBQ and counter structure in the 10 feet rear setback area and the 5 feet SIde setback arca. (c) The subject property IS described as 217-221-07 and IS located m the Resldenl1al Low DensIty (RLD) zone wlthm the neighborhood generally referred to as "College Park East". Smgle famIly residences m the Residenltal Low Density (RLD) Zone WEST Single famIly resIdences m the RcsIdentIal Low Density (RLD) Zone and Seal Beach TennIS Center in the Pubhc Land Use/Recreahon Zone (pLU/R) (e) The CIty received no comments, wntten or other, respondmg to the notIces of the hearmg on MPR 06-5 Section 5. Based upon the facts containcd III the record, mcludmg thosc stated m ~ 4 of thiS resolutIOn, and pursuant to ~ 28-401 of the CIty'S Code, the Planmng Commission hereby finds as follows (a) Mmor Plan ReView 06-5, as conditIOned, IS consistent With the provIsions of the Land Use Element of the City's General Plan, whIch proVides a "ReSIdentIal Low DenSity" deSignatIOn for the subject property and permits the proposed development, subJect to approval of a Mmor Plan ReView. The use IS also consistent With the remaining elements of the City's General Plan as the policies of those elements are consistent WIth, and reflected m, the Land Use Element Accordmgly, the proposcd use IS consistent With the General Plan (b) The proposed development, as conditIoned, complies With all dcvclopmcnt standards of the ReSidentIal Low DenSity (RLD) Zone (c) The BBQ and counter structure, as conditIoned, IS appropnate to the surroundmg neighborhood as the structure is an adequate dIstance from adJacent reSIdences. SectIon 6 Based upon the foregomg, the Planmng Commission hereby approves Mmor Plan ReVIew 06-5, subJect to the followmg condItIons: Mmor Plan ReView 06-5 IS approved at 3580 Aster Street. The proJect includes an approximately 48 mch hIgh BBQ and counter structure m the 10 feet rear setback area and m the 5 feet Side setback area. 2 All constructIon shall be In substantIal compliance With plans approved through MPR 06-5. 3 BUlldmg permIts shall be obtained for the approved structures, 4. ThIS Mmor Plan ReView shall not become effective for any purpose unless an "Acceptance of CondItions" form has been signed by the applicant in the presence of the DIrector of Development SefVlces, or notarized and returned to the Planmng Department, and unltl the ten (10) day appeal penod has elapsed 20f3 Planning CommissIOn ResolullOn No 06-20 Minor Plan Review 06-5 - 3580 Asler Slreel June 7, 2006 PASSED, APPROVED AND ADOPTED by the Planmng Commission of the City of Seal Beach at a meetmg thereof held on the 7th day of June 2006 by the following vote AYES Commissioners Deaton, Ladner, O'Malley, and Roberts, NOES.
