HomeMy WebLinkAboutPC Res 06-18 - 2006-05-17 RESOLUTION NUMBER 06-18 ORIGINAL A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 06-4, AN ARCHITECTURAL REVIEW OF A TWO STORY CABANA WHERE AN EXISTING TRAILER IS LOCATED AT 94 WELCOME LANE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On Apnl 5, 2006 Tracy LoUise Jones (''The applicant") filed an applIcal10n for Mmor Plan Review 06-4 with the Department of Development Services. Through MPR 06-4, the applicant sought architectural review approval to add 108 square feet of open deck area to the first floor and to add a new second floor of 522 square feet of living area and 126 square feet of deck area to an eXIsting trailer in the Seal Beach TraIler Park at 94 Welcome Lane, Seal Beach, The overall heIght would be less than 25 feet and the proposed structure would prOVIde a total of 1,062 square feet ofhving space and 234 square feet of outdoor deck area Section 2, Pursuant to 14 Calif, Code of Regs. ~ 15025(a) and ~ 1I.B of the City's Local CEQA GUldelmes, staff has determmed as follows: The application for Mmor Plan ReVIew 06-4 is categoncally exempt from reView pursuant to the California EnVIronmental Quahty Act pursuant to 14 Calif. Code of Regs. ~ 15303 NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES (a) single-family reSIdences not m conjunction with the bUIldmg of two or more such units In urbanized areas, up to three single-family residences may be constructed or converted under thIS exemption ~ 15061(b)(3), because It can be seen with certamty that there is no pOSSIbIlity that the approval may have a signIficant effect on the enVIronment. Section 3. A duly noticed hearing was held before the Plarming CommIssion on May 17, 2006 to consider the application for Minor Plan ReVIew 06-4, Section 4, The record of the heanng on May 17, 2006 indicates the followmg: (a) On April 5, 2006 Tracy Louise Jones ("The applicant") filed an applIcatIon for Mmor Plan Review 06-4 WIth the Department of Develop men I ServIces. Through MPR 06-4, the applicant sought arclutectural review approval to add 108 square feet of open deck area to the first floor and to add a new second floor of 522 square feet of living area and 126 square feet of deck area to an existing trailer in the Seal Beach Trailer Park at 94 Welcome Lane, Seal Beach, The overall heIght would be less than 25 feet and the proposed structure would prOVIde a total of 1,062 square feet ofliving space and 234 square feet of outdoor deck area (b) The subject property is located in the center of the Seal Beach Trailer Park abutting the parkmg area and is surrounded by residential uses WIthm the Park in all other dIrectIons. 10f3 Planmng CommISsIOn Re,olullOn No 06-18 Mmor Plan RevIew 06-4 - 94 Welcome Lane May 17, 2006 Section 5, Based upon the facts eontamed in the record, including those stated in ~ 4 of this resolutIon, and pursuant to ~~ 28-2319 of the CIty'S Code, the Planning CommissIon hereby finds as follows: (a) Mmor Plan ReView 06-4 IS consistent With the provIsIons of the Land Use Element of the City's General Plan, which provides a "high densIty residential" designatIon for the subJect property and permits trailer residentIal uses, The use is also consIstent With the remaImng elements of the CIty'S General Plan as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordmgly, the proposed use IS consIstent WIth the General Plan. (b) The property at 94 Welcome Lane IS adequate in size, shape, topography and locatIon to meet the needs of the proposed use of the property, (c) ReqUired adherence to applieable buildmg and fire codes ensures there Will be adequate water supply and utIlitIes for the proposed use. (d) The proposed use WIll be compatIble With surrounding uses and the community in general, because the style, height and bulk of the proposed structure, IS conSIstent with surroundmg residentIal uses, SectIon 6, Based upon the foregoing, the Planmng CommissIon hereby approves Mmor Plan Review 06-4, subJect to the followmg condttions' l. Mmor Plan ReVIew 06-4 is approved for a two-story cabana located at 94 Welcome Lane, Seal Beach, measunng approxImately 108 square feet of deck area on the first floor and 522 square feet of hvmg space and 126 square feet of outdoor deck area on the second floor. The two-story structure will provide a total of 1,062 square feet of livmg space and 234 square feet of outdoor deck area, 2, The maximum permitted buIlding height shall not exceed two stories or 25 feet m overall heIght, 3, The area between 20 feet and 25 feet in overall height shall conSIst exclUSIvely of roofing 4. No decks or balcomes shall be permItted above the floor level of the second story. 5 A life safety spnnkler system shall be installed throughout the traIler and cabana in accordance with the requirements set forth by the National Fire Protection ASSOCIation, Section No, 13D. 6, The extenor of the cabana shall be constructed of stucco, or one (1) hour fire-rated material shall be installed under wood siding. 20f3 Planning CommIssIOn ResolullOn No 06-/8 Minor Plan RevIew 06-4 - 94 Welcome Lane May 17. 2006 7, Approval shall be subJect to compliance with all applicable portions of Title 25 of the Cahfornia Admlmstrative Code and the Uniform Building Code. 8. The floor and axle of the eXisting trailer shall be maintained with all new constructIOn. 9 The overall structure shall provide a minimum setback of three (3) feet from side trailer space lines as designated in the map ofthe Seal Beach Trailer Park. 10 The applicant shall have a survey completed, whIch locates one of the mterior trailer lot line boundaries and location of the existmg trailer, This survey shall be submitted to the City for review before any butldmg permIt shall be obtained, II. All construction shall be in substantial compliance with the plans approved through Mmor Plan Review 06-4, 12. ThIS CUP shall not become effective for any purpose unless/until a CIty "Acceptance of ConditIons" form has been SIgned by the apphcant in the presence of the DIrector of Development Services, or notarized and returned to the Plarming Department; and unltl the ten (10) calendar-day appeal period has elapsed.
