A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING PLANNED SIGN PROGRAM 06-1 PERMITTING A PLANNED SIGN PROGRAM FOR THE SEAL BEACH CENTER AT 901-1101 P ACIFlC COAST mGHW A Y, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section I. On February 13, 2006, Sue Murdock, on behalf of UltrasIgns and Regency Centers, filed an application With the Department of Development Services for Planned Sign Program 06-1 Secl10n 2, Pursuant to 14 Calif Code of Regs. ~ 15301 and ~ 1l.B of the City's Local CEQA Guidelines, staff has determmed as follows: The apphcatIon for Planned SIgn Program 06-1 is categorIcally exempt from reView pursuant to the California Environmcntal QualIty Act pursuant to 14 Calif. Code of Regs. ~ 15305 (Minor AlteratIOns m Land Use LnmtatlOns), because the proposal mvolves a mmor alteration in land use limItation and does not mvolve eIther a property in excess of 20% slope or a change m land use or denSIty. SectIon 3. A duly noticed publIc heanng was held before the Planmng CommiSSIon on March 22, 2006, to conSIder the applicalton for Planned SIgn Program 06-1. SectIOn 4. The record of the hearmg of March 22, 2006 mdIcates the folIowmg: (a) On February 13, 2006, Sue Murdock, on behalf of UltrasIgnS and Regency Centers, filed an application With the Department of Development ServIces for Planned Sign Program 06-1 (b) Spcclfically, the applicant has submitted a "Sign Program" for the Seal Beach Center at 901-1101 PaCific Coast HIghway. The Program calls for wall SIgnS and SIX monument SIgnS along PaCIfic Coast HIghway (c) SectIOn 28-1803 sets forth the procedure to apply for a planned SIgn program (d) The subJect property IS deSCrIbed as Assessor's Parcel Numbers 043-260- 02 and 043-260-03. (e) Surroundmg land uses and zoning are as follows 10f4 ~ . (c) Approval of thIS request does not constitute the grantmg of special prIvIlege or allow substantial greater VISlbIhty thail the standard prOVIsIons allow. (d) The followmg Items have been considered as part of this Planned SIgn Program. I. Distance ofbUlldmgs from street 2 Size ofbUlldings 3 Traffic speed on the street 4. Arrangement ofbuildmgs on the lot or parcel 5. Number of anchor tenants ( e) ReSIdentIal neIghbors have stated concerns regarding lIght spillage from the property, mcludmg SIgn hghting. SectIon 6. Based upon the foregoing, the Plarming CommiSSIon hereby approves Plarmed SIgn Program 06-1 subJect to the following conditIOns: 1 Planned SIgn Program 06-1 IS approved for the Seal Beach Center for waIl SIgns and SIX monument SIgnS to Identify tenants and the center. 20f4 ~\ Plannmg Commrssloll Resolulwn 06-/4 Planlled SIgn Proglam 06-1 901-1101 Pacific Coa,t lltghway (Seal Beach Ce"ter) April 5. 2006 2 Any substantial devIalton from the program approved herein by the City must be approved through an amendment to this Planned Sign Program 3 In order to achIeve consIstency with the bUlldmg, all of the monument SIgnS WIll be of simIlar construclton and appearance and wall SIgnS and letterIng WIll be of sImIlar size accordmg to PaCific Coast HIghway frontage or other street frontages accordmg to this approved Planned Sign Program 4. This Plarmed SIgn Program IS for wall signs and monument sIgns only. Any addlltonal SignS, mcludmg window sIgns, must be wIthm the allowable SIgn regulaltons of the Mumclpal Code and should not be Visually mcompaltble as determIned by the Director of Development Services. 5. There shall be no business Idenltficalton signs on the market bUilding or the drug store bUilding facing Balboa DrIve or Bolsa Avenue towards a resldenltal zone, 6. The business identificalton SIgnS on the rear of the shop bUlldmg facmg Bolsa Avenue shall be tumed off at 9,00 pm, unless the business legally remams open after 9.00 p.m , in which case the sign light would be tuned off at closmg tIme 7 ThiS Plarmed SIgn Program shall not become effective for any purpose unless/unltl a CIty "Acceptance of Conditions" form has been SIgned by the applicant in the presence of the DIrector of Development ServIces, or notarized and returned to the Planmng Department; and untIl the ten (lO) calendar-day appeal period has elapsed. 8. ThIS Planned Sign Program shall become null and VOId unless exercised withm one (I) year of the date of final approval, or such extensIOn of tIme as may be granted by the Planmng CommISSion pursuant to a written request for extensIOn submItted to the Department of Development Services a mImmum of mnety (90) days prior to such expiration date PASSED, APPROVED AND ADOPTED by the Plarmmg Commission of the City of Seal Beach at a meetmg thcreofheld on the 5th day of Apnl 2006 by the followmg vote: AYES: CommIssIOners Shanks, Deaton, Ladner, O'Malley, and Roberts, NOES: CommIssIoners None ABSENT.
