A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING HEIGHT VARIATION 06-1, A REQUEST TO CONSTRUCT A COVERED ROOF ACCESS STRUCTURE IN CONJUNCTION WITH A NEW SINGLE FAMILY RESIDENCE AT 203 2ND STREET, SEAL BEACH, THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE' SectIon 1. On December 15, 2005, Mark Coppess ("The Applicant") submitted an applIcation for Height Variation 06-1 wIth the Department of Development Services, The applicant is proposmg to construct a covered roof access structure (CRAS) leadmg to a roof deck In excess of the height limit in conJunction with the construction of a new smgle- famIly residence at 203 2nd Street. Section 2 Pursuant to 14 CalIf, Code of Regs ~ 15025(a) and ~ II,A of the CIty's Local CEQA GuidelInes, staff has determmed as follows: The apphcatIon for Height VariatIon No. 06-1 is categorically exempt from review purSUallt to the CalifornIa Environmental QualIty Act pursuant to 14 Calif. Code of Regs, ~ 15303(a) (New ConstructIon of Small StructIIres), because the applicatIOn IS for the constructIon of three (3) or less smgle famIly dwellIngs in an urbamzed area; ~ 15305 (Minor AlteratIons m Land Use LimitatIOns) because the request is for a minor alteration In land use limItations m an area with an average slope of less than 20% and no changes in land use or denSIty are involved; and, pursuant to ~ 1506I(b)(3), because It can be seen wIth certainty that there is no pOSSIbIlIty that the approval may have a SignIficant effect on the environment. Section 3. A duly noticed publIc hearing was held before the PlaJmmg CommIssIon on February 8, 2005 to consider Height VariatIon 06-1. Section 4 The record of the hearing indicates the following: (a) On December 15, 2005, Mark Coppess submitted an applicatIon for Height VarIatIon 06-1. (b) The applIcant is requestIng a Height VarIatIon to construct a Covered Roof Access Structure (CRAS) in excess of the height lImit in conjunction with a new smgle-family dwellIng located at 203 2nd Street. (e) The surrounding land uses and ZOnIng are as follows: SOUTH MIX of single-famIly and multi-faJnily resIdential In ResIdential High Dcnsity (RHD) zone MIx of single-family and multI-family residential in ResIdential HIgh Density (RHD) zone, Across 2nd Street, mix of single-family and multi-famIly residential In Residential HIgh DensIty (RHD) zone. Across alley, mIx of smgle-faImly and multI-famIly resIdentIal In ResidentIal High Density (RHO) zone NORTH EAST WEST Section 5. Based upon the eVIdence m the record, includmg the facts stated in ~ 4 of this resolution and pursuant to ~ 28-2317(4) of the CIty'S Code. the PlaJmmg Commission hereby finds as follows: (a) The proposed covered roof access structure is not appropriate for the character and mtegrlty of the surrounding neighborhood and IS permissible by code (b) The proposed covered roof access structure signIficantly ImpaIrs the pnmary view of property located WIthIn 300 feet ofthe subJect property, Section 6, Height VariatIOn 06-1.
