HomeMy WebLinkAboutPC Res 06-06 - 2006-01-18 RESOLUTION NUMBER 06-6 o ,f>h 6'~ "1< A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 06-2, FOR AN ARBOR/TRELLIS STRUCTURE IN THE SIDE YARD SETBACK AREA AT 1504 OCEAN AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: SectIOn I On December 7, 2005, ("The Applicant") filed an applical10n for Mmor Plan RevIew 06-2 WIth the Department of Development Services Through MPR 06-2, the applIcant sought to construct an arbor/trellIs structure 7 feet, 10 inches high and 14 feet long In the 3 feet Side setback area at 1504 Ocean Avenue, Seal Beach, Section 2, Pursuant to 14 CalIf, Code of Regs, ~ 15025(a) and ~ II B of the CIty's Local CEQA GUIdelines, staff has determmed as follows The applicatIOn for Minor Plan Review 06-2 is categorically exempt from review pursuant to the CalifornIa Environmental QualIty Act pursuant to 14 CalIf Code of Regs, ~ 15303 NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES (a) smgle-famIly residences not in conJunctIOn wIth the buildmg of two or more such UnIts In urbanized areas, up to three smgle-famlly reSidences may be constructed or converted under this exempl1on. ~ 15061(b)(3), because it can be seen with certamty that there IS no possibility that the approval may have a SIgnIficant effect on the environment. Section 3 A duly noticed hearing was held before the PlannIng CommIssion on January 18, 2006 to consider the applIcatIon for Mmor Plan ReVIew 06-2. Section 4. The record of the hearing on January 18, 2006 mdicates the followmg: (a) On December 7, 2005, Patncia Wagner ("The ApplIcant") filed an applIcation for MInor Plan ReView 06-2 WIth the Dcpartment of Development SerVIces (b) SpecIfically, the request is to rctaIn an entry trellIs/arbor structurc constructed to replace an eXIstIng entry trellIs 3 feet Into the west Side 3 feet setback. Secl10n 5, Based upon the facts contaIned In the record, mcludmg those stated in ~ 4 of this resolutIon, and pursuant to ~~ 28-2081,28-401, and 28-2316 of the CIty's Code, the PlaJmIng CommissIOn hereby finds as follows: (a) MInor Plan ReVIew 06-2, as condItIoned, is consIstent WIth the prOVISIOns of the Land Use Element of the City's General Plan, which provides a "ReSIdentIal HIgh DenSIty" deSIgnation for the subJect property and permits the proposed development, subject to approval ofa Mmor Plan ReVIew. The use IS also consistent with the remaInIng elements ofthc City's General Plan as the polICIes of those elemcnts are consIstent WIth, and reflected in, the Land Use Element Accordmgly, the proposcd use is consIstent with the General Plan. (b) The proposed development, as condItIOned, complies with all development standards of the ReSidentIal HIgh Density (RHD) zone. (c) The trellis/arbor structure, as conditIOned, is appropnate to the surroundIng neighborhood, (d) The adJacent owner has proVIded a letter of support of thIS applIcatIon, and the proposed arbor/trellIs structure does not adversely affect other nelghbonng propertIes. SectIOn 6. Based upon the foregOIng, the PlannIng CommIssion hereby approves Minor Plan ReVIew 06-2, subject to the following conditIons: 1. MInor Plan Review 06-2 IS approved at 1504 Ocean Avenue, The proJect includcs an approxImately 7 feet, 10 inch high trellIS which is approximately 14 feet long In the 3 feet SIde sctback, 2.
