A RESOLUTION OF TI-IE PLANNING
COMMISSION OF THE CITY OF SEAL
BEACH RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT 06-1, AMENDING THE LAND
USE AND HOUSING ELEMENTS (400
MARINA DRIVE PROJECT)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:
Scction 1. On November 21. 2005 Schwendener Corporation
submitted requests for a General Plan Amendment, Zone Change and Tentative Parcel
Map WIth thc Department of Development SCrvlCCS
Section 2, The proposed project seeks approval of the following
actions, as requested by Schwendener Corporation:
D Amend the Land Use and Housing Elements of General Plan to
dcsignate a 13,667 square foot, 0 31.acre, property from Commercial General to
Residential High Dcnsity;
D Change thc zoning designatIOn on this parcel from General
Commercial (C-2) to Residential High Density (RHD), District I to be consistcnt with the
Gcncral Plan revision;
D Approve Tentatlvc Parcel Map 2005-257 to crcatc 4 parcels on lhe
approximately 0,31 acres, with a minimum parcel Size of2,937.5 square feet.
Section 3. Pursuant to 14 Calif, Code of Regs. ~ 15025(a) the City
prcparcd "lmtlal Study/Mil/gated Nl!gatlve DeclarallOn 06-1, General Plan Amendment 06-
1, Zone Change 06-1 and Tentative Parcel MlqJ 2005-257 - 400 Manna Drrve Projed'
(SCH# 2006021131), whIch was circulated for public review and comment from
February 23, 2006 to March 27. 2006, in compliancc with the provisions of the California
Environmental Quality Act.
Section 4 A duly noticed public hcaring was held beforc the Planning
Commission on Apnl 5, 2006 to conSider thc subject MitIgated Ncgative DeclaratIOn and
the requested land use applicatIOns. At thc public hearing, the Planning Commission
invited and considered any and all testimony offered In favor or opposition to said
Mitlgatcd Negative Declaration and land use applications

(a) The apphcant seeks approval ofthc following actIOns,
o Amend thc Land Use and Housing Elements of General
Plan to designate a 13,667 squarc foot, O,31.acre, property from Commcrcial General to
ResIdential !-ligh DensIty;
o Change the zoning desIgnation on this parcel from General
Commercial (C-2) to Residential High DenSIty (RHO), District I to be consistent WIth the
General Plan rcvision;
o Approve Tentativc Parcel Map 2005-257 to creatc 4 parccls
on the approxImately 0.31 acrcs, with a minimum parcel sizc of2,937,5 square feet
(b) The projcct site is irregular in shape, having approximately 80 feet
of frontage on Fourth Street and 137 feet of frontage on Marina Dnve, and is locatcd at
the southeast corner of the Intersection of Fourth Street and Marina Drivc
(c) The surrounding land uses and zoning are as follows
NORTH: Properties to thc north, across Marina Drive, are dcsignated
for Rcsidcntial Low Denslty-3000 development in both the General Plan and ZOnIng
Ordinance. These propertics are developed WIth detachcd residential UnIts and are
commonly known as "Bridgeport", Resldenccs in Bridgeport are lImIted to 2 ~tories in
hcight
EAST: Properties to the east. separated by a 15-foot public alley,
along Marina Dnve, are designated III the Gcncral Plan and ZonIng Ordinance for
"CommercIaI - Gcneral"' uses and are dcveloped with a small commcrcial development
consistIng of a liquor store and a take-out food store. Propertics to the soutiI of this
commercial area are deSIgnated in the General Plan and Zoning Ordinance for "Hlgh
Density Residential" uscs and are developed with a variety of detached and attached
residentIal hving units.
SOUTH. Properties to the south are designated in the Gcncral Plan
and Zoning Ordinance for "HIgh Density Residential"' uses and are developed With a
variety of detached and attachcd residential livIng UnIts.
WEST, Properties to the west are deslgnatcd in the General Plan
and Zoning OrdInance for "High Density Residential"' uses and are developed WIth a
variety of detachcd and attached residential livIng units
(d) The requested General Plan Amendment and Zone Change would
amend the Land Use and !-lOUSIng Elements of General Plan to deSignate the subject
13,667 square foot, 0 31.acrc, property from Commcrcial General to Rcsldcntial High
Density and changc the zoning deSignation on the subJect property from General
Commercial (C-2) to Residential High Density (RHO), District I to be consIstent with the
Gcneral Plan revision

(e) The mmimum lot sIze aJId area permittcd in thc Residcntial High
Density regulations is 25' x 100', WIth a mInImum lot arca of 2,500 square feet. The
proposed lots meet this requirement.
(f) All of the proposed dcvclopment on the parcels that would be
created by thc rcqucsted Parcel Map is not subject to any dIscretIOnary land usc
entitlement reviews by either the PlannIng Commission or CIty Council
(g) Marina Drive is a secondary street with a nght-of-way of 80 fcct
and Fourth Street is a local street With 60 fcct of right-of-way, Marina Drive underwent
an extensive renovatIOn In 2004 that included a reductIon 1Il vehIcle traffic lanes from 4
lanes to 2 lanes, provision of a 25-foot wide landscaped parkway along thc north sidc of
Manna Dnve A l2-foot wide oiTroad Class I multi-use bikeway is also providcd within
the landscapcd parkway,
SectIon 6. Based upon substantial evidence In thc rccord of the PlaJming
CommISSIon hcaring regarding tl1e applIcatIOn, Includmg the facts stated in ~ 3 and ~ 5 of
this resolution, and in the environmental documentation prepared in conJunction with t1us
project, aJId pursuant to *~ 28-2600 and 28-2602 of the CIty'S Code, the Planning
Commission hcrcby finds that General Plan Amcndmcnt 06-1, consisting of amendments to
the Land Use Element, Land Use Map, and Table 16 of tl1e I-lousing Elemcnt, will be
beneficial to the short tcrm and long term land use goals of the City of Seal Beach. The
Planning Commission further finds that approval of the subject amendment to the Land Usc
Element, Land Use Map, and fable 16 of the Housmg Element will promote the public
health, safety and welfare Thcrcfore, the Planning Commission finds that the requested
anlendments to thc Land Use Element. Land Usc Map, and Table 16 of the HOUSIng
Element of tl1e City of Seal Beach will bc in the public mterest, and makes the following
findings of fact.
(a) Thc proposed General Plan Amcndment to amend the Land Use
Element, Land Usc Map, and Table 16 ofthc Housing Element Will conform land uscs to
those set forth within the Land Use Element for the subjcct arca, as proposed to be
amcndcd pursuant to thiS request.
(b) The proposcd proJect will allow for a rcasonable range of land uscs
on thc subject property, recognIzing the compatibIlIty with adjacent residential and
commercial land uses
(c) The proposed projcct entitlement requests, and the necessary Gencral
Plan Amendment, Will not be detrimental to the short term or long term goals or objectives
of the CIty ofScal Bcach and are m the mtcrcst of the publIc health, safety and welfare. The
proposcd amendments are consIstent with the General Plan, as amended.

Commission hereby recommends that the CIty Council approvc Gcncral Plan Amendment
06-1 as set forth below,

below:
