A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL
BEACH RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF TENT A TIVE
PARCEL MAP 2005-257
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:
Section 1. On November 21, 2005 Schwendener Corporation
submitted requests for a General Plan Amendment, Zone Changc and Tentative Parcel
Map with the Department of Development ServIces.
Section 2 Thc proposed project seeks approval of the folloVl'lng
actIOns, as requestcd by Schwendener Corporation.
o Amend the Land Use and Housing Elements of Gcneral Plan to
designate a 13,667 square foot, 0 3l.acre, property from Commercial General to
Rc~idential High DenSIty,
o Change the zomng designation on this parccl from General
Commercial (C-2) to Residential High Density (RHO), DIstrict I to be consistent With the
General Plan reVISIOn;
o Approve Tentative Parcel Map 2005-257 to create 4 parcels on the
approximately 0 31 acres, with a mimmum parcel size of2,937 5 square feet.
Section 3 Pursuant to 14 Calif. Code of Regs. ~ 15025(a) the CIty
prepared ""Initial Study/Mtttgated Negative DeclaratIOn 06-1, General Plan Amendment 06-
1. Zone Change 06-1 and Tentative Parcel Map 200j-2j7 - -100 Manna Drive Project"'
(SCH# 2006021131). whIch was circulated for public review and commcnt from
February 23, 2006 to March 27, 2006, in compliance With the proVISIons of the California
Environmental Quality Act.
Section 4. A duly noticed public hearing was held before the Planning
Commission on April 5, 2006 to conSider the subject MItIgated Negative DeclaratIOn and
the rcquested land use applications. At the public hearing, the Plarming Commission
invited and considered any and all testimony offered in favor or opposition to said
MItigated Negative Declaration and land use applications.

(a) Tentative Parcel Map No. 2005-257 will creatc four new parcels
for residential development on thc subject property. Below is a summary ofthc proposed

SectIOn 6. Based upon substantial evidencc in the record of the
hearing, including the facts stated in Sections I through 4 of this resolution. and in thc
envIronmcntal documentation prepared in conjunction with this project, and pursuant to
~~ 28-2600 and 28-2602 of the City's Code, the Planning Commission hereby finds:
(a) The proposed Tentative Parcel Map is beneficial to the short tcrm
and long term land use goals of the City of Seal Beach; will promote the public health.
safety and welfare; and is in the public interest.
(b) The proposed Map IS consistent With applicable General Plan
elements and the proposed development application in that the Map will cstablish new
parcels that are consistent with said plans.
(c) The dcsign of the parcel map Will not interfere with eXIsting
easements, acquired by the public or utlhties that serve the pubhc.
(d) The SIte IS physically suitable for the proposed subdivision.
(e) The design of the subdivision is not hkely to cause substantial
environmental damage as all mitigation measures eontamed in MitIgated Negative
Declaration 06-1 to protect the environment will be Implemented
(f) Pursuant to ScctIOns 15070 through 15075 of the CEQA
GUidelines, a Mitigated Negative Dcclaration has becn prepared, This subdiVIsion is
within the scope of the Mitigated Negative Declaration, which adequately descnbes the
general environmental setting of the project and mItIgatIOn measures Identified to reduce
all identified impacts to "Le,s Than SIgmfieant With Mil1gatlOn Incorporated". No
additional envIronmental documentation IS needed.
Section 7, Based upon the foregomg. the Planning Commission of the
City of Seal Beach does recommend that the City Council approve Tentative Parcel Map
2005-257, subJect to the following conditJons.

1. Remove and replace all damaged concrete curb and guttcr, sidewalk, and
pavement
2. Remove eXisting driveway approaches and install new dnveways as shown on
plans. New curb and gutter shall be installed in areas where existing dnveway
approaches have been removed
3 Install additional 36-inch box trees WIthm the public right-of-way as determined
by the Director of Public Works.
4 The project shall comply with all scctIons as adopted in Resolution 5209, titlcd
Public Works Standard Conditions of Approval for Vcsting and Tentative and
Tcntativc Subdivision Maps, 2003 Edition.
5 Repair all damaged concrete in thc alley to the nearest full slab
6 Sanitary sewer lateral shall be installed to conform to city standards for each lot.
7, Water service laterals and meters shall be installed to conform to city standards
for cach lot.
8. All uhlities to be installed underground.
9. Additional strcet lights may be reqUired. A street light study shall be done to
dctcmline if additional street hghtmg is needed, Cost of study and any additional
street lights shall be patd for by the developer,
10 No driveways shall be constructcd facing Marina Drive or 4th Street Vehicle
access shall be from the alley.
ll, All conditions from thc City of Seal Beach Departments shall be incorporated mto
the parccl map prior to submIttmg thc final parcel map for reVIew
12. Documentation shall be provided indicating the mathematical accuracy, titlc
information and survey analysis of the parcel map and the correctness of all
certificates, Proof of ownershIp and proof of ongmal signatures shall also bc
rcqUlred,
13. Upon submittal of the final parcel map for review by the City of Scal Beach, a
letter signed by both the subdivider and the engmeer shall be provided, which
indicates that these mdIviduals agree to subnllt 5 blueprints, one 8 Yz X 11 copy,
and one mylar of the recorded parcel map to 1he City of Seal Beach Public Works

14 The apphcant shall indemnify, defend and hold harmless City, its ofticers. agents
and employees (collecl1vcly '.thc City" hereinafter) from any and all claims and
losses whatsoever occurring or resultmg to any and all persons, firms, or
corporations furnishing or supplymg work, services, materials, or supplies in
connection with the performance of thc use permitted hereby or the exercise of
the rights granted hercin, and any and all claims, lawsuits or actions arising from
the granting of or the exercise of the rights permitted by this Tentahve Parcel
Map, and from any and all claims and losses occurrmg or resulting to any person,
firm, corporatIOn or property for damage, mJury or death arising out of or
connected with the performancc of the use permitted hereby. Applicant's
obhgation to indemnify, defend and hold harmless thc City as stated herem shall
mclude, but not bc limited to, paying all fees and costs incurred by legal counsel
of the CIty'S choice in representmg the City in connection with any such claims,
lo~ses, lawsuits or actions, eXPCrt witness fees, and any award of damages,
Judgments. vcrdicts, court costs or attorneys' fces m any such lawsuit or actIOn.
