HomeMy WebLinkAboutPC Res 06-01 - 2006-01-18 RESOLUTION NUMBER 06-1 0-9/6';, 1t-'4( A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 06-1, FOR A ROCK SLIDE AND WATERFALL STRUCTURE IN THE REAR YARD SETBACK AREA AT 625 SILVER SHOALS AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Sechon 1 On November 21,2005, Mitchell Berro ("The Apphcant") filcd an apphcalion for Minor Plan Review 06-1 with the Department of Development Services. Through MPR 06-1, the applicant sought to construct an 8- fect lugh rock shde and waterfall structure with stam and rock wall m the 10 feet rear setback arca at 625 Silver Shoals Avenue, Seal Beach. Sechon 2. Pursuant to 14 Cahf. Code of Regs ~ 15025(a) and ~ II.B of the City's Local CEQA GUldelmes, staff has determmed as follows: The apphcalion for Minor Plan Rcvlew 06-1 is categoncally exempt from review pursuant to the California EnvIronmental Quahty Act pursuant to 14 Cahf. Code of Regs. ~ 15303 NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES (a) smgle-family reSidences not m conJunclion with the buildmg of two or more such units In urbamzed areas, up to three smgle-family residences may be constructed or converted under tlus exemption ~ 1506l(b)(3), because It can be seen with certamty that there IS no possibihty that the approval may have a slgmficant effect on the environment SectIOn 3 A duly noticed heanng was held before the Planning CommiSSion on January 18, 2006 to consider the apphcatlon for Mmor Plan ReView 06-1. Sechon 4. The record of the heanng on January 18, 2006 mdicates the followmg: (a) On November 21 2005, Mitchell Berro ("The Apphcant") filed an application for Minor Plan ReView 06-1 With the Department of Development Services. (b) Specifically, the request is to construct an 8-feet high rock shde and waterfall structure With stairs and rock wall m the 10 feet rear setback area. (c) The subject property is descnbed as 199-184-25, and IS located m the Resldenhal Low DenSity (RLD) zone withm the neighborhood generally referred to as "Manna Hill". (d) The surrounding land uses and zomng are as follows' NORTH' Smgle family reSidences in the ResldentJal Low Density (RLD) zone 10f3 Plannmg COmmu.slOn ResolutIOn 06- 1 Mmor Plan Review 06-1 - 625 Silver Shoal, Ave January 18, 2006 SOUTH: EAST: WEST: Single farmly residences m the Residenhal Low DenSity (RLD) zone Single farmly residences m the Residenhal Low Density (RLD) zone Smgle family residences m the Residential Low DenSity (RLD) zone (e) The City received no comments, wntten or other, respondmg to the notices of the hearing on MPR 06-1. Section 5, Based upon the facts contained in the record, mcludmg those stated m ~ 4 of this resolutIOn, and pursuant to ~ 28-40l of the City's Code, the Planning CommiSSion hereby finds as follows: (a) Minor Plan ReView 06-l, as condlhoned, is consistent with the provIsIons of the Land Use Element of the City's General Plan, which provides a "ResldentJal Low DenSity" deSignation for the subject property and permits the proposed development, subject to approval of a Minor Plan ReView. The use IS also consistent with the remammg elements of the City'S General Plan as the policies of those elements are consistent with, and reflected m, the Land Use Element. Accordmgly, the proposed use IS consistent with the General Plan. (b) The proposed development, as conditioned, complies With all development standards of the Residential Low DenSity (RLD) zone. (c) The rock slide and waterfall structure, as conditioned, are appropnate to the surrounding neIghborhood as the structures are an adequate distance from adjacent residences. SectIOn 6 Based upon the foregoing, the Plarming Commission hereby approves Minor Plan ReView 06-1, subject to the following condlhons: 1. Minor Plan ReView 06-1 is approved at 625 Silver Shoals Avenue The project mcludes an approximately 8-foot high rock shde and waterfall structure with stairs and rock wall m the 10 feet rear setback area. 2 All construction shall be m substantial compliance with plans approved through MPR 06-1 3 BUlldmg permits shall be obtamed for the approved structures. 4, This Minor Plan Review shall not become effcctive for any purpose unless an "Acceptance of ConditIOns" form has been Signed by the apphcant in the presence of the Director of Development Services, or notanzed and returned to the Plarming Department, and until the ten (10) day appeal period has elapsed.
