A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING CONDITIONAL USE
PERMIT 00-3, PERMITTING AN ADDITION TO A
NONCONFORMING BUILDING AT 615 OCEAN AVENUE,
SEAL BEACH; 853 SQUARE FEET ADDITION TO THE MAIN
HOUSE, AND A 10 SQUARE FOOT ADDITION TO THE
APARTMENT OVER THE GARAGE, AND 2 NEW TANDEM
PARKING SPACES.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE.
Section 1. On May 3, 2000, Paul Geijer ("The Applicant") subnutted an
applicatIOn for Conditional Use Penrut 00-3 wIth the Department of Development Services. The
applicant sought to add approximately 853 square feet to an existmg non-conforming property at
615 Ocean Avenue.
Section 2 Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ II.A ofthe
City's Local CEQA Guidelines, staff has determmed as follows: The application for Conditional
Use Permit 00-3 is categorically exempt from review pursuant to the California Environmental
QualIty Act pursuant to 14 Calif. Code of Regs. ~ 15301(e) (Existing FaCIlities), because It
involves an addition to an existing residential structure which increases the floor area by less
than 50% and is less than 2,500 square feet in area; and, pursuant to ~ 15061(b)(3), because it
can be seen With certainty that there is no possibility that the approval may have a sigmficant
effect on the enVITonment.
Section 3. A duly noticed hearmg was held before the Planmng Commission
on June 14,2000 and continued to July 19,2000 to consider Conditional Use PermIt 00-3
Section 4
The record of the hearing indicates the followmg:
(a) On May 3, 2000, Paul GeiJer subnutted an application for
CondItIOnal Use Permit 00-3.
(b) Specifically, the applicant IS seeking to add approximately 853
square feet to the main house, 10 square feet to the apartment over the garage, and 2 tandem
parking spaces to a property located at 615 Ocean Avenue, Seal Beach. The subject property IS
legal nonconforming due to inadequate parking and density.
(c) The subject property is described as Orange County Assessor's
Parcel Number 199-032-16 and is located in the Residential High DensIty zone of Old Town.
(d) The subject property is rectangular m shape with a lot area of
2,750 square feet.
(e) The surroundmg land uses and zoning are as follows:
NORTH, EAST &
WEST
A mixture of single family and multi-family residential uses in the
Residential High DenSIty zone (RHD).
SOUTH
Multi-family reSidential uses in a Residential High Density (RHD) Zone
and the muniCipal beach and Pacific Ocean in the Public Land Use I
Recreation zone (PLU/R).
(f) Staff has received no responses, wntten or other, to its mailed
notice regarding Conditional Use Permit 00-3

Section 5. Based upon the eVidence m the record, mcludmg the facts stated m
~ 4 ofthis resolution and pursuant to ~ 28-2407 of the City's Code, the Planning CommissIOn
hereby fmds as follows:
(a) Conditional Use Permit IS consistent with the provIsions of the Land Use
Element of the City's General Plan, which provides a "high density
residential" designatIOn for the subject property and permits single- and multi-
family residential uses. The u~e i~ also consistent With the remaming elements
of the City's General Plan as the polIcIes of those elements are consistent
with, and reflected in, the Land Use Element. Accordmgly, the proposed use
IS consistent with the General Plan.
(b) The bUlldmg and property at 615 Ocean Avenue. are adequate in size, shape,
topography and location to meet the needs of the proposed use of the property
and addition.
Section 6. Based on the foregomg, the Planning CommiSSIOn hereby approves
ConditIOnal Use Permit 00-3, subJect to the following conditions:
1 CUP # 00-3 is approved for the addition of approximately 853 square feet of living space
to the main structure at 615 Ocean Avenue, 10 square feet to the 1 bedroom apartment
above the garage, and 2 tandem parking spaces.
2. All construction shall be in substantial compliance WIth the plans subnutted for
Conditional Use Permit 00-3. Specifically, m addition to the proposed square footage
addition, the applicant will provide 2 additional parking spaces in tandem form.
3. This Conditional Use Permit shall not become effective for any purpose unless an
"Acceptance of Conditions" form has been signed by the applicant in the presence of the
Director of Development Services, or notarized and returned to the Planning Department;
and until the ten (10) day appeal penod has elapsed.
PASSED, APPROVED AND ADOPTED by the Planning Comnussion of the City of Seal Beach
at a meeting thereof held on the 19th Day of July, 2000, by the following vote:
