RESOLUTION NUMBER 1609
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING VARIANCE 6-
90, A REQUEST TO VARY FROM THE REQUIRED
GARAGE PARKING SPACE DEPTH IN THE RESIDENTIAL
LOW DENSITY ZONE (RLD) IN CONJUNCTION WITH
THE REMODEL OF AND ADDITION TO A SINGLE
FAMILY DWELLING AT 1140 CATALINA AVENUE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on December 24, 1990, a Brent Sears submitted an
application for Variance 6-90 to the Department of
Development Services requesting to provide less than
the required front yard setback or less than the
required garage depth in conjunction with the remodel
of, and second story addition to, a single family
dwelling located at 1140 Catalina Avenue, Seal Beach.
Specifically, the applicants are requesting to provide
a 17 foot front yard setback or a 19 foot deep garage
in conjunction with the proposed relocation of the
garage opening; and
WHEREAS, the applicants are requesting to relocate the garage
entrance from the present side entry to a front entry
garage. In so doing, the dr~ve way would be relocated
an additional 27'-6" away from the intersection; and
WHEREAS, the subject property is located on the easterly s~de of
catalina Drive approx~mately 54 feet north of the
intersection of Catalina Avenue and Balboa Avenue; and
WHEREAS, the subject property is located approximately 75 feet
from the northbound Balboa Drive limit line and
approximately 76 feet from the eastbound Catalina
Avenue limit line at the intersection of Balboa Drive
and Catalina Avenue; and
WHEREAS, the subject property is legally descr~bed as Lot 104 of
Tract 1817 as shown on a map recorded in Book 82, Pages
26-31 in maps located in the Off~ces of the County
Records of the Orange County, California; and
WHEREAS, the subject property currently provides a substandard
garage permitted under Section 28-403 of The Code of
the citv of Seal Beach; and
WHEREAS, staff inspection of the Hill area has discovered the
existence of six (6) or more legally constructed
dwellings providing less than the required front
setback; and
WHEREAS, The subject property is surrounded on all sides by
s~ngle family residences in the Res~dent~al Low Density
zone (RLD); and
WHEREAS, duly noticed public hearings were held on February 6,
1991, February 20, 1991 and March 6, 1991 to cons~der
Variance 6-90; and
WHEREAS, the Plann~ng Commission makes the following f~ndings:
1. Variance request 6-90 will not adversely affect
the General Plan.

2. There are special circumstances applicable to the
property at 1140 Catalina Avenue which, through
the strict application of the zoning code,
deprives the property of priv~leges enjoyed by
other property in the same vicinity and zone.
Specifically, 1140 Catalina Avenue is unique in
that it is located approximately 75 feet past an
intersection, has a 2-4 foot grade differential,
has a side entry garage and is located at a
completely controlled intersection.
3. The granting of Variance request 6-90 will not
constitute the granting of a special privilege
inconsistent with other limitations upon other
properties in the same vicinity and zone.
Specifically, Sect~on 28-403 of the Code allows
for add~t~ons to low density structures which are
nonconforming solely due to inadequate parking
dimensions, provided the garage area is at least
18' x 19'. The proposed addition/remodel of the
residence located at 1140 Catalina Avenue meets
these criteria and the existing garage at 1140
Catalina Avenue is presently nonconforming due to
inadequate width.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
city of Seal Beach does hereby approve Variance 6-90, subject to
the following conditions:
1. Variance 6-90 is approved to provide less than the required
parking space depth in conjunction with the addition of
approximately 2,042 square feet of habitable space to a
single family dwelling located at 1140 Catalina Avenue.
2. That a covenant be recorded on the title of the property
which stipulates that a sectional (roll-up) garage door be
permanently required in conjunction with the grant~ng of
Var~ance 6-90.
3. All construction shall be in substantial compl~ance w~th the
plans approved through Variance 6-90.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 6th day of
March, 1991, by the following vote:
