RESOLUTION No. 1653
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
#13-91, A REQUEST TO ALLOW CONSTRUCTION OF A
COVERED ROOF ACCESS STRUCTURE IN EXCESS
OF THE 35 FOOT HEIGHT LIMIT A B-112 SURFS I DE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, On August 5, 1991, David A. Byrnes filed an application
for Height Variat~on #13-91 and Variance #7-91: and
WHEREAS, The appl~cant ~s request~ng to allow construction of a
new single family residence, 37 feet in height, to allow
an exterior stairway from ground level to the second
floor and the construction of a covered roof access
structure ~n excess of the 35 foot height l~mit to a
height of 44 feet; and
WHEREAS, The subject property is legally described as Orange
County Assessor's Parcel Number 178-461-50; and
WHEREAS, The subject property is occasionally inundated by storm-
driven t~des and surf: and
WHEREAS, The surrounding land uses and zoning on all s~des of the
subject property is single fam~ly residences ~n the
Residential Low Dens~ty zone (RLD) w~thin the community
of Surfside Colony; and
WHEREAS, A duly noticed public hearing was held on October 2, 1991
to consider variance #7-91 and He~ght Variation #13-91;
and
,
WHEREAS, The Planning Commission makes the following findings
relative to Height Variation #13-91:
The proposed CRAS is:
1. Architecturally in keeping with the remainder of
the structure.
2. Is in keeping w~th the character and integrity of
the surrounding neighborhood.
3. As conditioned by staff, is limited to the m~nimum
size, both vertically and horizontally, necessary
to cover the staircase.
4. Due to the flat terra~n in the vic~ni ty of the
proposed structure, does not significantly impair
the primary view of any property located within 300
feet of the subject property.
NOW, THEREFORE, BE IT RESOLVED that the Plann~ng Comm~ssion of the
City of Seal Beach does hereby approve Height Var~ation request
#13-91, SUbJect to the following conditions:
1. Height Variation #13-91 is approved for a covered
roof access structure located at B-112 Surfside.
2. The applicant shall submit a spec~fic floor plan
for the CRAS and staff shall reduce the area of the
CRAS to a m~nimum area necessary to provide the
requ~red 6'8" head clearance for the stairway.
This will ensure the proposed CRAS will be the
minimum horizontal size necessary to cover the
stairwell.

3. All construction shall be in substantial compliance
with the plans approved through Height variation
#13-91.
PASSED, APPROVED AND ADOPTED by the Planning Comm~ssion of the City
of Seal Beach at a meeting thereof held on the 2nd day of October
1991, by the follow~ng vote:
