RESOLUTION No. 1652 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT #16-91, A REQUEST TO ESTABLSIH AN ENTERTAINMENT CAFE IN CONJUNCTION WITH NOEL'S, AN EXISTING RESTAURANT AT 16281 PACIFIC COAST HIGHWAY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On August 28, 1991, Salvatore Camelia filed an application for Conditional Use Perm~t 16-91 with the Department of Development Serv~ces; and WHEREAS, The applicant requested to establish an entertainment cafe in conjunct~on with Noel's, an ex~sting restaurant at 16281 Pac~fic Coast Highway, Seal Beach; and WHEREAS, The subject property ~s legally described as Orange county Assessor's Parcel Number 178-502-42; and WHEREAS, The restaurant has been operated in a similar manner for over thirty years with no adverse effects. The City has no records as to the actual construct~on date of the structure. However, the restaurant was in opeation in 1968 when the Surfside Colony was annexed into the c~ty of Seal Beach; and WHEREAS, The Planning Commission approved the on-sale service of beer, wine and distilled spirits through the approval of CUP #2-81 and approved a transfer of the liquor l~cense through the adoption of Resolut~on No. 1628 at its June 5, 1991 meeting; and WHEREAS, the surround~ng land uses and zoning are as follows: NORTH Across Pacific Coast H~ghway is a mixture of commercial uses located in the c~ty of Huntington Beach. SOUTH Single-fam~ly dwellings located w~thin the Surfside Colony in the Resident~al Low Density zone (RLD). EAST A used automobile dealersh~p in the General Commercial zone (C-2). WEST Pac~f~c Coast Highway; and WHEREAS, Seal Beach Chief of Police has reviewed the existing records and has no reservations about permitting the requested entertainment cafe. WHEREAS, a duly noticed public hearing was held on October 2, 1991 to consider Cond~tional Use Permit 16-91; and WHEREAS, the Planning Commission makes the following f~ndings: 1. The grant~ng of CUP 16-91 is consistent with the provisions of the General Plan which ind~cates the SUbJect property is to be used for general commercial purposes, which ~ncludes entertainment cafes when approved through the CUp process. 2. The bu~lding and property at 16281 Pacif~c Coast Highway are adequate in size, shape, topography and location to meet the needs of the proposed use of the property. : . . . ! . . Page 2 - Resolut~on No. 1652 3. Required adherence to appl~cable building and fire codes ensure there will be adequate water supply and util~t~es for the proposed use. 4. The provision of a single entertainer playing polynes~an must~c is compatible with the surrounding neighborhood. Adherence to conditions of approval placed on the use by both the City of Seal Beach and the Departmentof Alcoholic Beverage Control should mitigate any negative impacts to ne~ghboring resident~al propert~es. NOW, THEREFORE BE IT RESOLVED that the Plann~ng Commission of the city of Seal Beach does hereby approve Conditional Use Permit 16- 91, subject to the following condit~ons of approval: 1. CUP 16-91 is approved 16281 Pacific Coast Salvatore Camelia. for an entertainment cafe at Highway and ~s issued to 2. CUP 16-91 is non-transferrable. 3. Live enterta~nment shall be performed only between the hours of 7:00 p.m. and 11:00 p.m., Wednesday through Sunday nights. Live entertainment shall terminate precisely at 11:00 p.m. 4. Entertainment acts shall consist of no more than five (5) entertainers playing and/or s~nging music. Alteration of these standards shall be subject to review and approval by the Planning Commission. 5. All enterta~nment shall be performed ~n the restaurant's lounge area. 6. The exter~or lounge doors shall not be left open at any time when entertainment is being provided. 7. There shall be no customer danc~ng perm~tted on the prem~ses. 8. All enterta~nment shall comply with the city's noise standards, both for interior and exter~or noise, as set forth in Chapter 13-D of The Code of the citv of Seal Beach. CA. 9. The applicant shall, in a location acceptable to the Director of Development Serv~ces, prominently display the above-listed Conditions of Approval within the restaurant's lounge area. 10. Due to the prox~mity to ne~ghboring res~dential uses, the initial term of this permit shall be thre (3) months after wh~ch time the Planning Commiss~on shall review and may extend the perm~t provided that all cond~t~ons of approval have been satisfied and no signif~cant police problems have occurred.
