RESOLUTION NUMBER 1646
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 15-91, APPROVING AN ON-SALE BEER
AND WINE LICENSE IN CONJUNCTION WITH AN
EXISTING CAFE LOCATED AT 330 MAIN STREET, IF
(CAFE LAFAYETTE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on July 31, 1991 Fred H. Middaugh, Esq. filed an
application for CUP 15-91 on behalf of Cafe Lafayette;
and
WHEREAS, the applicant is requesting approval of an on-sale beer
and wine license in conjunction with an existing cafe
located at 330 Main Street, IF (Cafe Lafayette); and
WHEREAS, the subject property is located on the easterly side of
Main Street approximately 300 feet south of the
centerline of Pacific Coast Highway; and
WHEREAS, Cafe Lafayette is located within a mixed-use commercial
structure which is legally described as Lots 30, 32, 34
and 36 of Block 209 of the Bayview Tract, in the City
of Seal Beach, County of Orange, as per Map recorded in
Book 8, Page 91 of Miscellaneous Maps, in the Office of
the County Recorder of Orange County, State of
California; and
WHEREAS, the subject structure was constructed in 1988-89 and
currently meets all requirements of the Code of the
citv of Seal Beach (Code), including parking; and
WHEREAS, a sample of the menu is enclosed; and
WHEREAS, the surrounding land uses and zoning are as follows:
NORTH, SOUTH
WEST
A mixture of commercial uses in the
Service Commercial zone (C-1).
A mixture of single-family and multi-
family residential uses in the
Residential High Density zone, (RHD);
and
EAST
WHEREAS, William Stearns, Chief of police, has
reviewed this proposal and has no
reservations about permitting the requested
use; and
WHEREAS, a duly noticed public hearing was held on September 4,
1991 to consider CUP 15-91; and
WHEREAS, the Planning commission makes the following findings:
1. Staff inspected the subject property on August 26,
1991 and found that the restaurant meets all
requirement of the ~ and presently meets all
normal conditions of approval for establishments
serving on-sale alcoholic beverages.
2. The granting of CUP 15-91 is consistent with the
provisions of the General Plan which indicate the
subject property is to be used for service
commercial purposes, which includes on-sale
service of beer and wine.

3. The building and property at 330 Main street,
suite F are adequate in size, shape, topography
and location to meet the needs of the proposed use
of the property.
4. Required adherence to applicable building and fire
codes ensure there will be adequate water supply
and utilities for the proposed use.
5. The on-premises sale beer and is compatible with
the character of the Main street area. Adherence
to conditions of approval placed on the use by
both the City of Seal Beach and the Department of
Alcoholic Beverage Control should mitigate any
negative impacts to neighboring residential
properties.
6. The Seal Beach Police Department has reviewed the
existing records of the restaurant and has no
reservations regarding the requested license.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve CUP 15-91, subject to the
following conditions:
1. CUP 15-91 is approved for an on-sale beer and wine license
at 330 Main Street, suite F and is issued to Sima Torabi
and/or Monireh Bidarian and to their respective husbands,
Mohamad Tabrizi and Abdollah Torabi.
2. All alcoholic beverages shall be consumed entirely within
the building and none shall be sold as take-out.
3. No video games or similar amusements shall be permitted on
the premises without the obtainment of proper permits from
the City.
4. There shall be no alcoholic beverages advertised in the
window areas.
5. The applicant shall comply with all restrictions placed on
the license by the California Department of Alcoholic
Beverage Control.
6. CUP 15-91 shall be automatically terminated if the operation
is no longer maintained as a "bona fide eating place" as
defined by the state Department of Alcoholic Beverage
Control.
7. CUP 15-91 is non-transferrable.
8. With the applicant's consent, the hours of operation shall
be from 6:00 a.m. to 9:00 p.m. daily, except on Friday and
saturday nights when they will be open to 10:00 p.m.
9. The common restroom facilities located on the second story
of 330 Main street shall be open to restaurant patrons at
all hours when the restaurant is open for business. Door
keys for these restroom facilities will be available for
patrons, perhaps at the cashier's desk.
10. The applicants shall extend the existing hood to cover the
range top facilities. The applicants shall apply to the
Building Department for a Building Permit for said
extension.

11. The applicant shall, in a location acceptable to the
Director of Development Services, prominently display the
above-listed conditions of approval within the store's sales
area.
12. The term of this permit shall be twelve (12) months, after
which time the Planning Commission shall review and may
extend the permit indefinitely provided that all conditions
of approval have been satisfied and no significant police
problems have occurred.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 4th day of
September 1991, by the following vote:
AYES: Commissioners Dahlman, Law, Sharp, Orsini.
NOES:
ABSENT: Commissioner Fife.
