RESOLUTION NUMBER 1640 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING WITHOUT PREJUDICE CONDITIONAL USE PERMIT 10-91, A REQUEST TO PERFORM A SEISMIC RETROFIT, FACADE RENOVATION/REMODEL AND INTERIOR REMODEL TO AN EXISTING NONCONFORMING RESTAURANT/COMMERCIAL BUILDING LOCATED AT 209 MAIN STREET, SEAL BEACH; AND TO TRANSFER AN EXISTING ON-SALE BEER AND WINE LICENSE AND TO ESTABLISH AN "ENTERTAINMENT CAFE" IN CONJUNCTION WITH THE TRANSFER OF OWNERSHIP OF THE AFOREMENTIONED NONCONFORMING STRUCTURE. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, on June 6, 1991, Dwight Anderson filed an appl1cation for Conditional Use Permit 10-91 with the Department of Development Services; and the applicant is requesting to perform a seismlc retrofit of the structure, facade renovation/remodel and interior remodel to existing nonconforming restaurant/commercial bU1lding located at 209 Main Street, Seal Beach. Additionally, the applicant is requesting to transfer the existing on-sale beer and wine license and to establish an "Entertainment Cafe" in conjunction with the transfer of ownership of the aforementioned nonconforming structure; and the subject property is located on the westerly side of Main Street approximately 130 feet north of the center of the intersection of Main Street and Central Avenue; and the subject property is legally described as Lot 9 of Block 108 of Bay City Tract, as per Map recorded in Book 3 Page 19 of Miscellaneous maps, in the Off1ce of the County Recorder of Said County (Orange County, California); and the subject building, originally constructed as a bank in approximately 1925, is one of the oldest buildings on Main Street and an integral part of the 200 block of Main Street; and the subject building is constructed of unreinforced masonry.; and the subject property provides two (2) legal parking spaces on- site, plus adequate room for one (1) substandard compact space. The subject property is legally nonconforming due to inadequate on-site parking. However, due to the duration of the existing uses of the structure, the structure is grandfathered as meet1ng parking requirements; and The surrounding land use and zoning are as follows: A mixture of commercial uses in the Service Commercial zone, (C-l). A mixture of single-fam1ly and multi-family residential dwellings in the Residential High Density zone, (RHO); and William Stearns, Chief of Police, has reviewed the existing records and has no reservations about permitting either the requested transfer of the on-sale beer and wine license or the entertainment cafe request; and NORTH, EAST & SOUTH WEST a duly noticed public hearing was held on July 17, 1991 to consider CUP 10-91; and the Planning Commission makes the following findings: C:\~51\CUP\CUP91-10.RES . .
