RESOLUTION NUMBER 1639
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH APPROVING AN INDEFINITE EXTENSION OF
CONDITIONAL USE PERMIT (CUP) 8-90, AN OFF-SALE GENERAL
LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING LIQUOR
STORE AT 412 MARINA DRIVE (IRVINE LIQUOR)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:

on June 6, 1990, Elias Azar filed an application with the
Department of Development Services for Conditional Use Permit 8-
90, a request to transfer an existing off-sale general liquor
license in conjunction with the transfer of ownership of an
existing liquor store at 412 Marina Drive (Irvine Liquor); and
the subject property is located at the corner of Marina Drive and
Fifth Street, consisting of a four unit single story commercial
center, of which the convenience store (liquor store) is'the
largest of the four units; and
a staff inspection of the site on July 8, 1991, revealed the
applicant has abided by all conditions of approval of CUP 8-90;
and
the current use of the property is a convenience store that sells
alcoholic beverages; and
the surrounding land uses and zoning are as follows:
NORTH
Across Marina Drive are single family homes in
the Residential Low Density zone, (RLD).
Residential uses in the Residential High Density
zone, (RHD).
SOUTH & WEST
Across Fifth Street is a church in the General
Commercial zone, (C-2) and residential uses in
the RHD zone; and
William Stearns, Chief of Police, has reviewed the existing
records, and has no reservations about permitting the operation to
continue; and
EAST
a duly noticed public hearing was held on July 17, 1991 to
consider an indefinite extension of CUP 8-90; and
the Planning Commission makes the following findings:
1.
the applicant is requesting to continue the sale of
alcoholic beverages which has historically been permitted at
this site;
2.
the granting of CUP 8-90 is consistent with the provisions
of the General Plan which indicate the subject property is
to be used for service commercial purposes;
the building and property at 412 Marina Orive are adequate
in size, shape, topography and location to meet the needs of
the proposed use of the property;
required adherence to applicable building and fire codes
ensure there will be adequate water supply and utilities for
the proposed use;
no complaints have been received regarding the sale of
alcohol at the site since the original CUP was granted;
staff inspected the subject property and determined that all
original conditions of approval have been met;

7. no negative commentary has been received by staff to date,
in response to the mailed notice regarding the proposed
indefinite extension of CUP 8-90; and
8. the Seal Beach Police Department has reviewed the existing
records of the establishment and has no reservations
regarding the requested extension.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve an indefinite extension of CUP 8-90, subject to the
following conditions:
1. CUP 8-90 is approved for an off-sale general liquor license at 412
Marina Drive, and is issued to Elias Azar.
2. CUP 8-90 is non-transferrable.
3. No alcoholic beverage advertising or display devices shall be located in
the window areas and outside of the store.
4. With the applicant's consent, the hours of operation shall be 6:00 a.m.
to 11:00 p.m. Sunday through Thursday, and 6:00 a.m. to 12:00 a.m.
Friday and Saturday.
5. The applicant shall comply with all restrictions placed on the llcense
by the California Department of Alcoholic Beverage Control.
6. No video games or similar amusements shall be permitted on the premises
without proper City permits.
7. CUP 8-90 is extended indefinitely provided that all conditions of
approval are met and no significant police problems occur.
B. The apllicant shall, in a location acceptable to the D1rector of
Developent Services, prominantly display the abovelisted conditions of
approval within the store's sales area.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal
Beach at a meeting thereof held on the 17th day of July 1991, by the following
vote:
