RESOLUTION NUMBER 1626 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT (CUP) 5-91, ALLOWING A MAJOR ADDITION AND REMODEL TO THE FRONT UNIT OF A NONCONFORMING DUPLEX LOCATED AT 20B AND 20B% FOURTH STREET, SEAL BEACH. THE SUBJECT PROPERTY IS NONCONFORMING DUE TO DENSITY (LOT AREA PER DWELLING UNIT) AND APPROVED TANDEM PARKING. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: The granting of CUP 5-91 is consistent with the provisions of the General Plan which indicate the subject property is to be used for residential high density purposes. The subject property is adequate in size, shape, topography and location to meet the needs of the proposed use of the property. Required adherence to applicable building and fire codes will ensure there will be adequate water supply and utilities for the proposed use. The proposed addition is in keeping with the requirements of Section 28-2407(A)(4) of The Code of the Citv of Seal Beach, as the subject property is nonconforming solely due to density and tandem parking. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve CUP 5-91, subject to the following conditions: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, on April 1, 1991, Edward and Marla Wicorek filed an application with the Department of Development Services for Conditional Use Permit 5-91, requesting a major addition and remodel to the front unit of a duplex located at 208 and 208% Third Street, Seal Beach. The subject property is nonconforming due to density (lot area per dwelling unit) and approved tandem parklng; and the subject property, legally defined as Lot 8, Block 104 of Tract 698, as per map recorded in Book 31, page 27 of Miscellaneous Maps, in the office of the county recorder of said county, is a rectangular lot with 3D' x 117.5' dimensions (3525 square feet); and the subject property is located on the easterly side of Fourth Street approximately 110 feet northward of the center of the intersection of Fourth Street and Central Avenue; and the subject property is surrounded on all sides by a mixture of single family dwellings and multiple family dwellings in the Residential High Density zone, (RHD); and the subject property is nonconforming due to density and tandem parking. The subject property contains a duplex and therefore provides a density (lot area per dwelling unit, as defined in the ~ of 1,762% square feet per unit while the ~ requires a density of 2,178 square feet per unit; and the applicants added a new four car tandem garage and second unit above the garage in 1977. Additionally, at that time the applicants converted the original three bedroom front unit to a two bedroom unit, converting the two rear bedrooms to a master bedroom/den; and a duly noticed public hearing was held on May 15, 1991 to consider CUP 5-91; and the Planning Commission makes the following findings: 1. 2. 3. 4. Conditional Use Permit 5-91 is approved for the addition of approximately 1210.75 square feet to the front unit of the duplex located at 208 and 208% Fourth Street, Seal Beach. 2. The family room fireplace shall be relocated to the southeasterly corner of said room. 3. The exterior doorway to the stairwell shall be removed from the stairwell and relocated to the northerly exterior side wall of the family room, thereby eliminating the potential for direct exterior access to the stairwell. 4. The area of the roof deck shall not exceed 500 square feet. 5. All construction shall be in substantial compliance with the plans approved through CUP 5-91. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 15th day of May, 1991, by the following vote: AYES: Commissioners Fife.
