RESOLUTION NUMBER 1621
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH APPROVING CONDITIONAL USE PERMIT (CUP)
4-91, ALLOWING A MAJOR ADDITION AND REMODEL TO THE
FRONT UNIT OF A NONCONFORMING DUPLEX LOCATED AT 207
AND 207% THIRD STREET, SEAL BEACH. THE SUBJECT
PROPERTY IS NONCONFORMING DUE TO DENSITY (LOT AREA PER
DWELLING UNIT) AND APPROVED TANDEM PARKING.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:

on February 26, 1991, Michael Aviani filed an application with the
Department of Development Services for Conditional Use Permit 4-91
and Height Variation (MPR) 2-91, requesting the construction of a
covered, roof-access structure, remodel and major addition to the
front unit of a duplex located at 207 and 207~ Third Street, Seal
Beach. The subject property is nonconforming due to density (lot
area per dwelling unit) and approved tandem parking; and
the subject property, legally defined as Lot 7, Block 102 of Tract
698, as per map recorded in Book 31, page 27 of Miscellaneous
Maps, in the office of the county recorder of said county, is a
rectangular lot with 30' x 117.5' dimensions (3525 square feet);
and
the subject property is located on the westerly side of Third
Street approximately 120 feet northward of the center of the
intersection of Third Street and Central Way; and
the subject property is surrounded on all sides by a mixture of
single family dwellings and multiple family dwellings in the
Residential High Density zone, (RHD); and
the subject property is nonconforming due to density and tandem
parking. The subject property contains a duplex and therefore
provides a density (lot area per dwelling unit, as defined in the
~) of 1,762~ square feet per unit while the ~ requires a
density of 2,178 square feet per unit; and
the applicants added a new four car tandem garage and second unit
above the garage in 1978. Additionally, at that time the
applicants converted the original three bedroom front unit to a
two bedroom unit, converting the two rear bedrooms to a master
bedroom/bath, and a laundry room; and
a duly noticed public hearing was held on April 3, 1991 to
consider CUP 4-91; and
the Planning Commission makes the following findings:
1. The granting of CUP 13-90 is consistent with the provisions
of the General Plan which indicate the subject property is
to be used for residential high density purposes.
2. The subject property is adequate in size, shape, topography
and location to meet the needs of the proposed use of the
property.
3. Required adherence to applicable building and fire codes
ensure there will be adequate water supply and utilities for
the proposed use.
4. The proposed addition is in keeping with the requirements of
Section 28-2407(A)(4) of The Code of the Citv of Seal Beach.

NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve CUP 4-91, subject to the following conditions:
1. CUP 4-91 is approved for the addition of approximately 1,152 square feet
to the front unit of the duplex at located 207 Third Street, Seal Beach.
2. All construction shall be in substantial compliance with the plans
approved through CUP 4-91.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal
Beach at a meeting thereof held on the 3rd day of April, 1991, by the
following vote:
