RESOLUTION NUMBER 1617
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING AN INDEFINITE
EXTENSION OF CONDITIONAL USE PERMIT 4-90, AN
ON-SALE BEER AND WINE LICENSE IN CONJUNCTION
WITH AN EXISTING RESTAURANT LOCATED AT 3001
OLD RANCH PARKWAY. (SOUP EXCHANGE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on January 24, 1990, Robert parini filed an application
for Conditional Use Permit 4-90 on behalf of Soup and
Salad Systems, Inc. with the Department of Development
Services requesting to transfer an existing on-sale beer
and wine license in conjunction with the transfer of
ownership of an existing restaurant located at 3001 Old
Ranch Parkway; and
WHEREAS, the Planning Commission approved CUP 4-90 at its April
18, 1990 meeting through the adoption of Resolution 1572;
and
WHEREAS, Resolution 1572 granted CUP 4-90 for an a initial period
of twelve (12) months after which time the Planning
Commission was to reconsider the use with the option of
extending the use indefinitely, provided all conditions
of approval had been met and no significant police
problems have occurred; and
WHEREAS, the Planning commission initially approved the on-sale
service of beer and wine for the site through the
adoption of Conditional Use Permit 2-88; and
WHEREAS, the subject property is located within the Bixby Office
Park, a multiple-tenant, mixed use project located at
Seal Beach Boulevard and the 1-405 freeway; and
WHEREAS, the surrounding land uses and zoning are as follows:
NORTH
A flood control channel and single family
homes located in Rossmoor, an unincorporated
community in the County of Orange.
SOUTH
The Beverly Manor reservoir and fire station,
separated from the subject property by the 1-
405 freeway.
A vacant lot in the C-2 (General Commercial)
Zone, separated from the subject property by
Seal Beach Boulevard.
EAST
WEST
Office buildings within the Bixby Office Park;
and
WHEREAS, Staff inspected the subject property on April 9, 1991 and
found the site to be abiding by all conditions of
Resolution 1572; and
WHEREAS, William Stearns, Chief of police, has reviewed the
existing records and has no reservations about permitting
the operation to continue; and
WHEREAS, The Planning Commission held a duly noticed Public
Hearing on April 17, 1991 to consider an indefinite
extension of Conditional Use Permit 4-90; and

WHEREAS, the Planning commission makes the following findings:
1. The service of beer and wine in conjunction with an
existing restaurant at 3001 Old Ranch Parkway will
not adversely impact the surrounding neighborhood.
The subject property has possessed an on-sale beer
and wine license for two years with no reported
impacts. The subj ect property is surrounded on
three sides by commercially zoned properties and
the freeway and to the north by single-family
residences separated from the site by a flood
control channel.
2. The service of beer and wine is appropriate for the
restaurant use of the subject property.
3 . No complaints have been received regarding the
service of beer and wine at the site since the
original CUP was granted.
4. Staff inspected the subject property and determined
that all original conditions of approval have been
met.
5. No negative commentary has been received by staff
to date, in response to the mailed notice regarding
the proposed indefinite extension of CUP 4-90.
NOW, THEREFORE BE IT RESOLVED that the Planning commission of the
City of Seal Beach does hereby approve an indefinite extension of
CUP 4-90, subject to the following conditions:
1. CUP 4-90 is approved for an on-sale beer and wine license at
3001 Old Ranch Parkway and is issued to Soup and Salad
Systems, Inc. d/b/a The Soup Exchange.
2. All alcoholic beverages shall be consumed entirely within the
building, and none shall be sold as take-out.
3. No video games or similar amusements shall be permitted on the
premises without the obtainment of proper permits from the
city.
4. There shall be no alcoholic beverages advertised in the window
areas.
5. The applicant shall comply with all restrictions placed on the
license by the California Department of Alcoholic Beverage
Control.
6. CUP 4-90 shall be automatically terminated if the operation is
no longer maintained as a "bona fide eating place" as defined
by the State Department of Alcoholic Beverage Control.
7. CUP 4-90 is non-transferrable.
8. with the applicant's consent, the hours of operation shall be
from 11:00 a.m. to 9:30 p.m. daily.
9. CUP 4-90 is extended indefinitely provided all above-listed
conditions are met and no significant police problems occur.

of Seal Beach at a meeting thereof held on the 17th day of April,
1991, by the following vote:
