RESOLUTION NUMBER 1615 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING A SIX (6) MONTH EXTENSION OF CONDITIONAL USE PERMIT (CUP) 12-89, A REQUEST FOR THE PLACEMENT OF TWELVE (12) COIN-OPERATED AMUSEMENT DEVICES WITHIN THE LOBBY OF WITHIN A THEATRE (SUPER SAVER CINEMA SEVEN) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHERAS, WHEREAS, the Super Saver Cinema Seven Theatres, Inc. is owned by Associated Theatres, Inc. and Lyco Financial, Inc.; and the subject property is located within the Rossmoor Business Center and is surrounded on all sides by said Center; and the first floor area, consisting of the lobby, restrooms, concession and storage areas, and all seven (7) theatres encompasses an area of approximately 23,577 square feet. The lobby measures approximately 4,410 square feet in area; and the subject property possesses a valid City business license for the operation of a theatre; and a duly noticed public hearing was held on September 20, 1989 to consider CUP 12-89 at which the Planning Commission approved the request for a period of six (6) months (this period was subsequently reviewed and extended for an additional six (6) months). Approval was subject to eight (8) conditions and contained a five step "video area control method"; and a duly noticed public hearing was held on October 3, 1990 to consider an extension of CUP 12-89. In conjunction with this review, the Commission requested a review of the escalating police problems associated with the theatre and granted a six (6) month extension of the CUP; and on April 3, 1991 the Planning Commission held a duly noticed public hearing to consider an extension of CUP 12-89; and the Planning Commission makes the following findings: 1. The extension of CUP 12-89 is consistent with the provisions of the General Plan which indicate the subject property is to be used for general commercial uses. 2. The subject property is adequate in size, shape, topography and location to meet the needs of the proposed use of the property. Specifically, the lobby area is of adequate size and is accessible only through the purchase of a theatre admission to ensure proper usage of the video gaming area. 3. Required adherence to applicable buildlng and fire codes ensure there will be adequate water supply and utilities for the proposed use. 4. Required adherence to the conditions of approval as well as the .video area control method" will ensure proper usage of the video gaming area. 5. The loitering problem in the parking area adjacent to the theatre has continued to exist. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve a six (6) month extension of CUP 12-B9, subject to the following conditions: 1. Planning Commission Res. No. 1616 Page 2 2. That persons shall be allowed to play the machines only after the purchase of a theater admission ticket. 3. That the video game machines be turned off upon the closing of the ticket booth for the final shows of the evening, at approximately 10:30 p~ 5. That the on-duty manager of the theater shall monitor the video game area to prevent the loitering of individuals in the lobby. 6. That the business license fee for the coin-operated amusement devices be paid to complete the application process. 7. That with the applicant's consent, the hours of operation shall be between 12:00 p.m. (noon) and 12:00 a.m. (midnight) for the public and between 9:00 a.m. and 12:00 a.m. (midnight) theater employees. 8. That no person shall be permitted to play the coin-operated amusement devices during hours when any public or private school is in regular session in the cities if Seal Beach, Los Alamitos or the unincorporated area known as Rossmoor unless such person's age is 18 years or more. The theater manage shall require proper identification in cases of doubt. 9. A sign, not less than three (3) square feet in area, shall be clearly posted at the video game machine area stating that use of the machines is limited to holders of tickets for a theater performance on the premises. 10. A sign, not less than six (6) square feet in area, shall be clearly posted at the video game machine area stating that use of the machines is not permitted by persons under the age of 18 years during hours when any public or private school is in regular session in the cities if Seal Beach, Los Alamitos or the unincorporated area known as Rossmoor unless such person's age is 18 years or more. The theater manage shall require proper identification in cases of doubt. 11. Staff will review the loitering situation at the three (3) month interval of the six (6) month extension and provide a brief report back to the Commission at that time.
