(CUJl.J:MB TlW)B LJ:QUOR) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on January 16, 1990, Gopal Seth filed an application with the Department of Development Services for Conditional Use Permit 2-90, to transfer an existing off-sale general liquor license in conjunction with the transfer of ownership of an existing liquor store at 12101 Seal Beach Boulevard, Seal Beach. (Carriage Trade Liquor); and WHEREAS, on March 7, 1991 the Plannlng Commission granted CUP 2- 90 through the adoption of Resolution 1569 subject to eight (8) conditions; and WHEREAS, Condition No. 7 granted the Cup for a period of twelve (12) months, after which time the Planning Commission shall review and may extend the permit indefinitely provided that all conditions of approval have been satisfied and no significant police problems have occurred; and WHEREAS, The subject property is located at the extreme northerly end of the Rossmoor Business Center, roughly at the southwest corner of Seal Beach Boulevard and Bradbury Drive; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH A gasoline service station in the General Commercial zone, (C-2) and single family residences located within the City of Los Alamitos. SOUTH The Rossmoor Business Center in the General Commercial zone, (C-2). EAST Single family residential uses located within the City of Los Alamitos. WEST High density residential uses located within the City of Los Alamitos.; and WHEREAS, William Stearns, Chief of Police, has reviewed the existing records, and has no reservations about permitting the operation to continue; and WHEREAS, A duly noticed public hearing was held on April 3, 1991; and WHEREAS, the Planning commission makes the following findings: 1. The subject business has operated at this location for several years with no history of complaints or adverse activity. C:\WPS1\CUP\CUP90--2.RS2 '. . . . Planning Commission Resolution 1615 Page 2 2. Police Department review indicates no serious police problems have occurred over the past twelve months. 3. Staff inspected the site on March 28, 1991 and found the premises to be meeting all of the original conditions of approval of Conditional Use Permit 2-90. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the city of Seal Beach does hereby approve an indefinite extension of Conditional Use Permit 2-90, subject to the following conditions: 1. CUP 2-90 is approved for an off-sale general liquor license at 12101 Seal Beach Boulevard, and is issued to Gopal Seth. 2. CUP 2-90 is non-transferrable. 3. No alcoholic beverage advertising or display devices shall be located in the window areas and outside of the store. 4. with the applicant's consent, the hours of operation shall be 6:00 a.m. to 12:00 a.m. (midnight) Sunday through Thursday and 6:00 a.m. through 1:00 a.m. Friday and Saturday. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. No video games or similar amusements shall be permitted on the premises without the obtainment of proper permits from the City. 7. CUP 2-90 is extended indefinitely provided that all conditions of approval are met and no significant police problems occur. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 3rd day of April, 1991, by the following vote: AYES: commissioners Fife. Sharp.
