HomeMy WebLinkAboutPC Res 92-79 - 1992-12-09 ... . ~ RESOLUTION NUMBER 92-79 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-45, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 1514 OCEAN AVENUE, SEAL BEACH, CALIFORNIA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, on July 21, 1992, Ernest E. Van Dorn submitted an application for Height Variation 92-45 to the Department of Development Services; and the application requests after-the-fact approval of a height variation for an existing covered roofaccess structure (CRAS) at 1514 Ocean Avenue. The existing CRAS is rectangular in shape and has an area of approximately 70 square feet; and this application was submitted to comply with the requirements of City Ordinance 1322 which set forth new standards for the construction and maintenance of CRAS's within the City. Ordinance 1322 requires a property owner of an existing CRAS apply to the City for a Height Vanation if their existing CRAS does not conform to the new standards; and the existing CRAS at 1514 Ocean Avenue exceeds the maximum area of 38.25 square feet necessary to cover the stairwell; and the subject property is legally described as Orange County Assessors's Parcel Number 199-093-06; and the subject property is surrounded on all sides by single family and multiple family residences in the Residential High Density zone (RHO); and a duly noticed public hearing was held on December 9, 1992, to consider Height Variation 92-45: and during the Public Hearing on Height Variation 92-45 there was no opposition, either written or verbal, to the granting of this request; and the Planning Commission makes the following findings: 1. The existing CRAS is architecturally in keeping with the remlUnder of the structure, with the roofing materials and siding matching those of the remainder of the structure; 2. The existing CRAS is in keeping with the character and integrity of the surrounding neighborhood where numerous covered roof-access structures have been constructed in close proximity to the subject property; 3. The existing CRAS exceeds the minimum horizontal dimensions necessary to cover the stairwell, however, due to the configuration c IWPSIIRBSOIHV92-45 PClLWlI2-04-92 . . Due to the flat terrain in the vicinity of the proposed structure, it does not significantly impair the primary view of any property located within 300 feet of the subject property. 5. There was no opposition of any kind expressed during the public hearing on Height Variation 92-45. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve of Height Variation 92-45 permitting an existing covered roof-access structure at 1514 Ocean Avenue, Seal Beach, as constructed.
