A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
APPROVING HEIGHT VARIATION 92-39, A
REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT 254 SIXTEENTH
STREET, SEAL BEACH, CALIFORNIA
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:

on July 22, 1992, James Burtrum submitted an application for Height
Variation 92-39 to the Department of Development Services; and
the application requests after-the-fact approval of a height variation for an
existing covered roof access structure (CRAS) at 254 Sixteenth Street. The
existing CRAS is rectangular in shape and has an area of approximately
102.5 square feet; and
this application was submitted to comply with the requirements of City
Ordinance 1322 which set forth new standards for the construction and
maintenance of CRAS's within the City. Ordinance 1322 requires a
property owner of an existing CRAS apply to the City for a Height
Variation if their existing CRAS does not conform to the new standards;
and
the existing CRAS at 254 Sixteenth Street exceeds the maximum area of
38.25 square feet necessary to cover the stairwell; and
the subject property is legally described as Orange County Assessors's
Parcel Number 199-064-40; and
the subject property is surrounded on all sides by single family and
multiple family residences in the Residential Medium Density zone
(RMD); and
a duly noticed public hearing was held on November 18, 1992, to
consider Height Variation 92-39: and
during the Public Hearing on Height Variation 92-39 there was no
opposition, either written or verbal, to the granting of this request; and
the Planning Commission makes the following findings:
1. The existing CRAS is architecturally in keeping with the remainder
of the structure, with the roofing materials and siding matching
those of the remainder of the structure;
2. The existing eRAS is in keeping with the character and integrity
of the surrounding neighborhood where numerous covered
roof-access structures have been constructed in close proximity to
the subject property;

3. The existing CRAS was constructed in accordance with the plans
approved in March of 1989, with final inspection on May 23,
1990;
4. The existing CRAS exceeds the minimum horizontal dimensions
necessary to cover the stairwell, however, due to the configuration
of the stairwell, no habitable living space is provided within the
structure; and
5. Due to the flat terrain in the vicinity of the proposed structure, it
does not significantly impair the primary view of any property
located within 300 feet of the subject property.
6. There was no opposition of any kind expressed during the public
hearing on Height Variation 92-39.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve of Height Variation 92-39 permitting an existing
covered roof-access structure at 254 Sixteenth Street, Seal Beach, as constructed in accordance
with plans approved by the City in March 1989, with final inspection on May 23, 1990.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 18th day of November, 1992, by the
following vote:
