RESOLUTION NUMBER 92-60
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-35, A REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT A-95 SURFSIDE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE.
WHEREAS, on July 21, 1992, Wayne and Cyntlna Tomlinson submitted an application for
Height Variation 92-35 to the Department of Development ServJces, and
WHEREAS, the application requests after-the-fact approval of a height variation for an existing
covered roof access structure (CRAS) at A-95 Surfside. The existing CRAS has
an area of approximately 57.5 square feet; and
WHEREAS, this application was submitted to comply with the requirements of City Ordinance
1322 which set forth new standards for the construction and maintenance of
CRAS's within the City Ordinance 1322 requires that a property owner of an
existing CRAS apply to the City for a Height Variation if their existing CRAS does
not conform to the new standards; and
WHEREAS, the existing CRAS at A-95 Surfside exceeds the maximum area of38 square feet
necessary to cover the straight stairwel1; and
WHEREAS, the subject property is legally described as Orange County Assessor's Parcel
Number 178-462-24, and
WHEREAS, the subject property IS surrounded on three Sides by single family residences in the
Residential Low Density zone (RLD) of Surfside and PacIfic Coast Highway to the
north; and
WHEREAS, a duly noticed public hearing was held on November 4, 1992, to consider Height
Variation 92-35; and
WHEREAS, during the public hearing on Height Variation 92-35 there was no opposition,
either written or verbal, to the granting of this request, and
WHEREAS, the Planning Commission makes the following findings

1 The existing CRAS is architecturally in keeping with the remainder of the
structure, with the roofing materials and siding matching those of the
remainder of the structure;
2. The existing CRAS is in keeping with the character and integrity of the
surrounding neighborhood where numerous covered roof-access structures
have been constructed in close proximity to the subject property;
3 The existing CRAS was constructed in accordance with the plans approved
through Building Permit 119, issued on December 9, 1981,
4 The existing CRAS exceeds the minimum horizontal dimensions necessary
to cover the stairwell, however, due to the configuration of the stairwell,
no habitable living space is provided within the structure, and
5. Due to the flat terrain in the vicinity of the proposed structure, it does not
significantly impair the primary view of any property located within 300
feet of the subject property
6 There was no opposition of any kind expressed during the public hearing
on Height Variation 92-35
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve of Height Variation 92-35 permitting an existing covered roof-access
structure at A-95 Surfside, Seal Beach, as approved through Building Permit 119 issued on
December 9, 1981 subject to the following condition
I The applicant shall schedule a final inspection pursuant to Building Permit #119 within 30
days of the approval of this request and shall receive final approval of Building Permit
#119 within 120 days of the approval of this request
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach
at a meeting thereof held on the 4th day of November, 1992, by the following vote
