RESOLUTION NUMBER 92-54 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-28, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT A-84 SURFSIDE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on July 16,1992, Donald Waldron submItted an applicatIon for Height Vanatlon 92-28 to the Department of Development SeTVIces, and WHEREAS, the application requests after-the-fact approval ofa height vanatlon for an eXlstmg covered roof access structure (CRAS) at A-84 Surf side The exlstmg CRAS has an area of approxImately 100 square feet, and WHEREAS, tins application was submitted to comply WIth the requlTements of CIty Ordmance 1322 whIch set forth new standards for the constructIOn and mamtenance of CRAS's Wlthm the CIty Ordmance 1322 reqUires that a property owner of an eXIstmg CRAS apply to the CIty for a Height VariatIon nthelT eXIstmg CRAS does not conform to the new standards, and WHEREAS, the eXIstmg CRAS at A-84 Surf side exceeds the maximum area of 42 25 square feet necessary to cover the Circular stlUrwell, and WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel Number 178-472-4, and WHEREAS, the subJect property IS surrounded on three SIdes by smgIe farmly reSidences m the ResldentlaJ Low DenSity zone (RLD) of Surf sIde and the PaCIfic Ocean to the south, and WHEREAS, a duly notIced pubhc heanng was held on November 4, 1992, to conSIder Height Vanatlon 92-28, and WHEREAS, dunng the pubhc heanng on Height Vanatlon 92-28 there was no oppOSItion, eIther wntten or verbal, to the grantmg of tins request, and WHEREAS, the Planmng ComnusslOn makes the follOWIng findmgs C \AMIPRO\DOCS\MPR\R92-2B BCC be ~ Planmng ComlUlsslon ResoluUon 92-54 November 5, 1992 I The eXIstmg CRAS IS arclntecturally m keepmg WIth the remamder of the structure, WIth the roofing matenals and sldmg matclnng those of t1te remainder of the structure, 2 The exlstmg CRAS IS m keepmg with the character and IDtegnty of the surroundmg neIghborhood where numerous covered roof-access structures have been constructed m close proxlnuty to the subJect property, 3 The eXIstmg CRAS was constructed m accordance WIth the plans approved through BUlldmg Pemut 408, ISSUed on March 26, 1986, 4 The eXIstmg CRAS exceeds the mlmmum honwntal dimenSIOns necessary to cover the staIrwell, however, due to the configuratIon of the stairwell, no habitable liVIng space IS proVIded wlthm the structure, and 5 Due to the flat temun m the Vlcmlty of the proposed structure, It does not slgmficantly ImplUr the pnmary VIew of any property located wltlnn 300 feet ofthe subJect property 6 There was no opposItion of any kIDd expressed dunng the public hearing on HeIght Vanatlon 92-28 NOW, THEREFORE BE IT RESOLVED that the Plamung Commission of the CIty of Seal Beach does hereby approve of Height Vanatlon 92-28 pemuttmg an eXIstmg covered roof-access structure at A-84 Surf side, Seal Beach, as approved through Bulldmg PermIt 408 ISSUed on March 26, 1986 PASSED, APPROVED AND ADOPTED by the Planmng CommIssion of the CIty of Seal Beach at a meetmg thereof held on the 4th day of November, 1992, by the follOWIng vote AYES ComnusslOners Sham.
