HomeMy WebLinkAboutPC Res 92-53 - 1992-11-04 , RESOLUTION NUMBER 92-53 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-27, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT B-28 SURFSIDE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on September 10, 1992, John M ArtukoVlch submitted an application for Height Vanatlon 92-27 to the Department of Development SeTVIces, and WHEREAS, the apphcatlOn requests after-the-fact approval of a height vanatlOn for an exlstmg covered roof access structure (CRAS) at B-28 Surf sIde The existing CRAS has an area of approxImately 84 2 square feet, and WHEREAS, tins applicatIOn was submitted to comply WIth the reqUIrements of City Ordmance 1322 which set forth new standards for the constructIOn and mamtenance of CRAS's Wltlnn the City Ordmance 1322 requires that a property owner of an eXIstmg CRAS apply to the CIty for a Height VanatIon If their eXIstmg CRAS does not conform to the new standards, and WHEREAS, the eXlstmg CRAS at B-28 Surf side exceeds the maximum area of 62 25 square feet necessary to cover the rectangular stairwell, and WHEREAS, the subject property IS legally descnbed as Orange County Assessor's Parcel Number 178-491-9, and WHEREAS, the subJect property IS surrounded on three Sides by smgle famdy reSidences m the ReSIdential Low DenSity zone (RLD) of Surf side and PaCific Coast HIghway to the north, and WHEREAS, a duly noticed pubhc heanng was held on November 4, 1992, to conSIder Height VanatlOn 92-27, and WHEREAS, dunng the public heanng on HeIght Vanatlon 92-27 there was no OppOSItIOn, eIther wntten or verbal, to the grantmg of tins request, and WHEREAS, the Planmng CommissIon makes the foIl oWIng findmgs C\AMIPRO\DOCS\MPR\R92.27 ace be , Plannmg Comnusslon ResoluUon 92-53 November 5, 1992 I The eXlstmg CRAS IS arclntecturally m keeping WIth the remlUnder of the structure, with the roofing matenals and sldmg matclnng those of the remlUnder of the structure, 2 The eXIstmg CRAS IS m keepmg WIth t1te character and mtegnty of the surroundmg neighborhood where numerous covered roof-access structures have been constructed m close proXInuty to the subJect property, 3 The eXlstmg CRAS was constructed in accordance WIth tlte plans approved through Bulldmg Pemut 2033, issued on May 2, 1989, 4 The eXIstmg CRAS exceeds the nummum horizontal dlnlenslons necessary to cover the stairwell, however, due to t1te configuratIon of the stairwell, no habitable hvmg space IS prOVIded Wltlnn the structure, and 5 Due to the flat terram m the Vlclmty of the proposed structure, It does not S1gmficantly ImpaIr the pnmary VIew of any property located WIthIn 300 feet of the subJect property 6 There was no opposItion of any kmd expressed dunng the public heanng on HeIght Vanatlon 92-27 NOW, THEREFORE BE IT RESOLVED that the Planmng ComnusslOn of the CIty of Seal Beach does hereby approve of Height Vanatlon 92-27 permlttmg an eXIstmg covered roof-access structure at B-28 Surf sIde, Seal Beach, as approved through BUlldmg Permit 2033 Issued on May 2, 1989 PASSED, APPROVED AND ADOPTED by the Planmng CommissIon of the CIty of Seal Beach at a meetmg thereof held on the 4th day of November, 1992, by the followmg vote AYES ComnusslOners Shafll.
