RESOLUTION NUMBER 92-52
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-26, A REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT B-27 SURFSIDE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE
WHEREAS, on September 10, 1992, John M ArtukoVlch subnutted an application for Height
VanatlOn 92-26 to the Department of Development SeTVIces, and
WHEREAS, the applicatIon requests after-the-fact approval of a height vanatlOn for an eXIstmg
covered roof access structure (CRAS) at B-27 Surf sIde The eXIstmg CRAS has
an area of approXImately 84 2 square feet, and
WHEREAS, tins application was subnutted to comply WIth the reqUIrements of CIty Ordmance
1322 whIch set forth new standards for the constructIOn and mamtenance of
CRAS's Wltlnn the CIty Ordmance 1322 reqUires that a property owner of an
eXIstmg CRAS apply to the CIty for a Height Vanatlon If their eXIstmg CRAS does
not conform to the new standards, and
WHEREAS, the eXlstmg CRAS at B-27 Surf side exceeds the maximum area of 62 25 square
feet necessary to cover the rectangular staIrwell, and
WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel
Number 178-491-52, and
WHEREAS, the subJect property IS surrounded on three SIdes by smgle farmly reSIdences m the
ReSIdential Low DenSIty zone (RLD) of Surf sIde and PacIfic Coast HIghway to the
north, and
WHEREAS, a duly noticed pubhc heanng was held on November 4, 1992, to conSIder HeIght
Vanatlon 92-26, and
WHEREAS, dunng the pubhc heanng on Height Vanatlon 92-26 there was no opposition,
either wntten or verbal, to the grantmg of tins request, and
WHEREAS, the Planmng Commission makes the follOWIng findmgs

The exlstmg CRAS IS arclntecturally in keepmg WIth the remaInder of the
structure, WIth the roofing matenals and SIdmg matchmg those of the
remamder of the structure,

The eXIstmg CRAS IS m keepmg WIth the character and mtegnty of t1te
surroundmg neighborhood where numerous covered roof-access structures
have been constructed m close prOXImity to the subJect property,

The exlstmg CRAS was constructed m accordance WIth the plans approved
through Bulldmg Permit 3133, ISSUed on October 19, 1989,

The eXIstmg CRAS exceeds the mimmum honzontal dimenSIOns necessary
to cover the stlUrwell, however, due to the configuration of the stlUrwell,
no habItable hVlng space IS proVIded Wlthm the structure, and

Due to the flat terrlUn m the vlclmty of the proposed structure, It does not
slgmficantly ImplUr the pnmary VIew of any property located Wlthm 300
feet of the subJect property

There was no OpposItIon of any kmd expressed dunng the pubhc heanng
on HeIght VariatIOn 92-26
NOW, THEREFORE BE IT RESOLVED that the Planmng CommiSSIon of the CIty of Seal
Beach does hereby approve of Height Vanatlon 92-26 pernuttmg an exlstmg covered roof-access
structure at B-27 Surf sIde, Seal Beach, as approved through Bulldmg Pemut 3133 Issued on
October 19, 1989
PASSED, APPROVED AND ADOPTED by the Planmng ComnusslOn of the CIty of Seal Beach
at a meetmg thereof held on the 4th day of November, 1992, by the followmg vote
